Article 25 of the Law on Trade Union 2024 stipulates the responsibilities of employers to the Union as follows: Acknowledging, respecting, creating conditions and not obstructing, making it difficult for workers to conduct legal activities to establish, join and operate trade unions; coordinate with trade unions to perform the functions, rights, responsibilities and obligations of the parties in accordance with the law; coordinate with unions of agencies, organizations, units and businesses they develop, promulgate and implement the Regulation on coordination of activities between the two parties.
In addition, the employer is responsible for acknowledging and creating conditions for grassroots trade unions to exercise the rights and responsibilities in accordance with the law; exchanging, providing adequate, accurate and timely information related to the organization and operation as prescribed by law when the Trade Union proposed, unless otherwise provided for by law; coordinate with the Trade Union to organize dialogues, collective negotiations, sign and implement collective labor agreements and regulations on grassroots democracy, organize conferences of cadres, civil servants, officials and employees in accordance with the law.
Employers must collect trade unions before deciding on issues related to the rights and obligations of employees in accordance with the law; coordinate with trade unions to resolve labor disputes and issues related to the implementation of labor laws in accordance with the law; ensure the conditions of trade union and trade union officials in accordance with the law and pay the trade union fund in accordance with this Law.
Meanwhile, the 2012 Trade Union Law (currently in effect) does not use the concept of "employer", but stipulates the responsibilities of agencies, organizations, and enterprises towards the Trade Union (in Article 22,).
According to the definition of the Trade Union Law 2024, employers are agencies, organizations, units, enterprises, cooperatives, cooperative unions, households, individuals who hire, hire, use workers and pay salaries and wages according to the provisions of law.
