On May 8, the Khanh Hoa Provincial Federation of Labor (LDLD) coordinated with relevant agencies to organize the settlement of complaints from collective employees (NLD) at Mai Linh Nha Trang Company Limited regarding payment of unpaid wages and closing social insurance (SI) books. This is the second time the Provincial Federation of Labor has worked with Mai Linh Nha Trang to resolve the long-standing complaint situation.

According to Mr. Nguyen Minh Quan, a driver working in Mai Linh Nha Trang for nearly 14 years is currently owed 3 months' salary, 3 years and 6 months of late payment of social insurance and vehicle documents.

More painfully, Mr. Quan's father, Mr. Nguyen Than, has worked at the Company for 12 years, but unfortunately recently passed away from illness and has not yet settled the debt.

"My father passed away, the Company still has not paid the deposit and unpaid wages to my father. My youngest child is 4 years old, should have gone to kindergarten, but it was too difficult, so I still leave him at home to reduce the cost.

The family now has a hard time taking care of their 3 children and elderly mother, I myself do not dare to report illness, I have contacted the Company many times but have only promised" - Mr. Quan said.

The case of driver Nguyen Thanh Dat having a very serious traffic accident. Currently, Mr. Dat is in one place but many times the family representative went to the Company to request settlement of related rights, closed the social insurance book, and the deposit (10 million VND), the Company still pushed him back and did not pay.

Among the 31 workers who submitted petitions was Mr. Le Van Toan, who was owed wages from August to November 2024 with an amount of nearly 14 million VND and social insurance of more than 70 million VND. Notably, in 2019, the Company mobilized employees to buy cars to accompany Mai Linh and Mr. Toan to sign a car purchase contract until the contract expired on April 7, 2024. However, the Company has not yet handed over the vehicle registration certificate to Mr. Toan, so he cannot sell or put the vehicle into use because he does not have legal documents

I myself have lung cancer, I am the main breadwinner, and my assets are in a hurry to be exposed to the sun, my vehicles cannot be sold, and I do not have money for treatment. The company only promised not to share the difficulties with the employees" - Mr. Toan said indignantly.

Enterprises continue to promise

Chairing the meeting, Mr. Phan Thanh Liem - Chairman of the Khanh Hoa Provincial Federation of Labor informed that at the first meeting, Mai Linh Nha Trang Company Limited owed nearly 6 billion VND in social insurance and nearly 2 billion VND in wages to employees. In addition, the Company still owes employees deposit money and vehicle documents.

Director Mai Linh Nha Trang committed to resolving social insurance debts under the old legal entities before January 15, 2025; finalizing the payment of social insurance under the new legal entities before January 24, 2025; paying at least 50% of salary before January 24, 2025 and paying the remaining 50% before March 30, 2025 to all employees.

However, up to now, the Company has only paid 1.3 billion/2 billion VND in unpaid wages to employees. Many recommendations and reflections from employees and the Company's leaders still do not fulfill their obligations as committed. Meanwhile, many employees who are in debt are facing many difficulties.

A representative of Khanh Hoa Social Insurance said that every month, they send debt notices to the company in great detail, every quarter they send notices of non-compliance and will recommend inspection to impose a fine. Recently, the Social Insurance has issued a document inviting the company to work to make a debt record of more than 6 billion but has not yet provided a solution.

At the meeting, Mr. Ha Dang Luyen - Chief of Office of the Board of Directors of Mai Linh Group Joint Stock Company requested to check information related to vehicle documents and committed to 2 contents of vehicle documents, the deposit in May will be resolved.

The parties also agreed that the Company would divide the salary to pay to 31 employees who submitted applications and must complete before August 8, 2025. Mai Linh Nha Trang must be responsible for paying to employees.

Regarding social insurance, in the immediate future, 3 special cases will be resolved with a written notice to the social insurance company for early settlement for employees. The Company must fully pay the remaining amount and complete it in the third quarter of 2025.

"If businesses continue to delay and do not comply, the Trade Union and related units will implement solutions according to the provisions of law" - Mr. Liem said.
