In which, the authority to sign a contract to perform the duties of civil servants is clearly stipulated in Article 8.
Article 8. Authority to sign the contract
1. For signing a work performance contract as prescribed in Clause 1, Clause 3, Article 4 of this Decree: The head of a civil servant management agency decides to sign a contract or decentralizes and delegates the signing of a contract to the head of an agency employing civil servants who is assigned a payroll, operating expenses, has his own seal and account.
2. For signing a work implementation contract as prescribed in Clause 2, Article 4 of this Decree: The head of the agency employing civil servants is assigned a payroll, operating expenses, has a seal and a separate account that decides to sign the contract after reporting and having the policy of the head of the agency managing civil servants approved.
Regarding the subjects of application of Decree 173 on the basis of Article 2.
Article 2. Subjects of application
1. Agencies of the Communist Party of Vietnam, the State, the Vietnam Fatherland Front, socio-political organizations at the central level, at the provincial and commune levels.
2. Agencies, organizations, units and individuals sign labor contracts and service contracts.
3. Diplomatic missions, consular missions, representative agencies at international organizations, and other Vietnamese agencies abroad shall sign labor contracts and service contracts to perform one or more tasks under the management of Vietnamese agencies abroad as prescribed in this Decree.
4. The Minister of National Defense and the Minister of Public Security shall decide on the application of the provisions of this Decree to sign labor contracts and service contracts to perform one or more tasks under their management.
