Clause 2, Article 28 of Decree 33/2023/ND-CP stipulates as follows:
Retirement for commune-level cadres and civil servants
1. Commune-level cadres and civil servants are entitled to retire according to the provisions of the law on labor and the regulations of the Party and central socio-political organizations.
2. 6 months before the date of retirement of commune-level cadres and civil servants, the competent authority managing commune-level cadres and civil servants must notify in writing about the time of retirement; 3 months before the date of retirement of commune-level cadres and civil servants, the competent authority managing commune-level cadres and civil servants must issue a retirement decision.
Meanwhile, according to Decree 33, the Secretary of the Commune-level Party Committee is a title of a commune-level cadre.
Thus, 3 months before the date of retirement of the Commune Party Secretary, the competent authority managing commune-level cadres must issue a retirement decision.
