Regulations on termination of office for commune-level cadres

The Lao Dong Newspaper Legal Consulting Office replied:

Article 27 of Decree 33/2023/ND-CP stipulates the termination of positions for commune-level cadres and the termination of jobs for commune-level cadres and civil servants as follows:

1. Commune-level cadres who cease to hold positions and commune-level civil servants who quit their jobs (except for cases of job transfer and cases of disciplinary action according to the provisions of law on cadres and civil servants) are entitled to the allowance for leaving their positions for commune-level cadres, the allowance for leaving work for commune-level civil servants and is calculated according to the Government's regulations on severance allowance for civil servants.

2. Commander of the commune's military command, if disciplined by dismissal without arranging and arranging other civil servants at the commune level, they will be resolved within the regime within 30 days from the date of disciplinary decision to take effect. In addition to the regime of resignation, entitled to the provisions of Clause 1 of this Article, the commander of the commune's military command also enjoys other regimes in accordance with the law on militia and self -defense militia.

3. The funding source for paying leave allowances for commune-level cadres and leave allowances for commune-level civil servants is arranged in the annual regular expenditure estimate of the People's Committee at the commune level assigned by competent authorities.

Thus, the termination of office for commune-level cadres is regulated as above.
