According to Article 36 of Decree 170/2025/ND-CP (effective from July 1, 2025), the time for reappointment or extension of the term of office of civil servants in leadership and management positions is as follows:
When civil servants in leadership and management positions have expired their term of appointment as prescribed, the competent authority or organization must conduct a process to consider reappointing or extending the term of office in leadership and management positions. In case the reappointment process has not been carried out, the term of office has been extended as prescribed in Clause 5 of this Article or the term of office has been extended, but new details have arisen, so when the term of office of appointment expires, the civil servant in charge of leadership and management has not yet had a decision to reappoint or extend the term of office, the competent authority appointing must have a written notice to let the agency, organization, unit and civil servant know.
The decision to reappoint or the decision to extend the term of office of a leader or manager must be issued at least 1 working day before the date of appointment.
In case, for objective reasons, the time of signing the reappointment decision or the decision to extend the term of office of leadership and management after the appointment term expires, the appointment period of the new decision shall be calculated from the date of appointment of the old decision and must be clearly stated in the decision.
