Article 18 of the 2019 Law on Militia and Self-Defense Forces (amended by Article 10 of the Law amending 11 Laws on Military and Defense 2025, effective from July 1, 2025) stipulates as follows:
Militia and Self-Defense Command System
1. Minister of National Defense.
2. Chief of the General Staff of the Vietnam People's Army.
3. Commander of the military region, Commander of the army, Commander of the Border Guard, Commander of the Coast Guard, Commander of the Hanoi Capital Command, Commander of the army, Commander of the company.
4. Commander of the Ho Chi Minh City Command, Commander of the provincial military command.
5. The head of a military enterprise has a self-defense organization.
6. Commander of the Military Command of agencies and organizations.
7. Commander of the Commune-level Military Command.
8. Battalion Commander, Squadron Commander, Company Commander, Squadron Commander, Lieutenant Commander, Captain, and Captain of the Militia and Self-Defense Unit.
9. Village captain.
Accordingly, the Village Captain belongs to the Militia and Self-Defense Command system according to the law.
