Court summons to work on trade union lawsuit demanding Tet bonus for workers

The People's Court of Region 1 - Dong Nai announced the summons of the parties to work on May 6 related to the case of the Executive Committee of the grassroots Trade Union of Tenma Co., Ltd. (HCM) Vietnam suing to request the company to reward Tet bonuses for employees at least 1 month's salary.

Court accepts case, summons defendant to work

The People's Court (TAND) of Region 1 - Dong Nai has announced the acceptance of the civil case; at the same time, there is a summons for the parties to work related to collective labor disputes regarding rights - requesting employers to pay Tet bonuses to employees.

According to the Court's notice, the issues that the plaintiff requests the Court to resolve include: Forcing Tenma (HCM) Vietnam Co., Ltd. to pay Tet bonuses to employees at a level of at least one month's salary in accordance with the provisions of Article 10 of the Collective Labor Agreement that the two parties have signed.

Tenma (HCM) Vietnam Co., Ltd., located at Bien Hoa 2 Industrial Park, Tran Bien ward, Dong Nai province is the defendant.

According to the plaintiff's lawsuit, the Executive Committee of the grassroots Trade Union of Tenma (HCM) Vietnam Co., Ltd.: In the content of the collective labor agreement in Article 10, there is a regulation that every year, the company rewards Tet bonuses to employees who are working at least 1 month's salary if they work for all years. However, on January 20, 2026, the company's Board of Directors informed the Executive Committee of the grassroots Trade Union about the Tet bonus level of 0.7 months' salary based on the production and business situation in 2025. The Executive Committee of the grassroots Trade Union requested the company to reconsider the bonus level according to the collective labor agreement, which is at least equal to 1 month's salary.

Also according to the lawsuit, although dialogues have been organized many times between the company's Board of Directors, the Executive Committee of the grassroots Trade Union and employees, and there has also been the participation of agencies, departments and the Dong Nai Provincial Labor Federation, the company still unilaterally issued a notice that the bonus level is lower than the agreement between the two parties signed. The Executive Committee of the grassroots Trade Union has consulted employees and agreed to request competent authorities to resolve labor disputes. Mr. Vu Ngoc Ha - an expert on labor law - said: The bonus level issued by the company is lower than the collective labor agreement and is not appropriate.

Workers request to properly implement collective labor agreements

According to the grassroots Trade Union of Tenma (HCM) Vietnam Co., Ltd., a company with hundreds of employees, on Tet 2025, the company will give Tet bonuses at 1.8 months' salary, but Tet 2026 will only give bonuses at 0.7 months' salary, causing workers to be upset.

Talking to reporters of Lao Dong Newspaper, many workers of Tenma Co., Ltd. (HCM) Vietnam said that they want the company to properly implement the collective labor agreement signed, and give Tet bonuses of at least 1 month's salary to workers.

Ms. H (an anonymous worker) who has worked for 10 years at Tenma Co., Ltd. (HCM) Vietnam said: During the Binh Ngo Tet 2026, the company only gave Tet bonuses of 0.7 months' salary, making her family not have enough money to prepare for Tet for both paternal and maternal grandparents. Ms. H hopes the company will pay Tet bonuses fully according to the collective labor agreement, at least 1 month's salary.

Ms. L (an anonymous worker) who has about 20 years of experience working at Tenma (HCM) Vietnam Co., Ltd. said that she supports the Executive Committee of the grassroots Trade Union of Tenma (HCM) Vietnam Co., Ltd. in protecting the rights of union members and employees related to Tet bonuses, because the company does not properly implement the collective labor agreement. At the same time, she also hopes that the company will properly implement the signed collective labor agreement, and give Tet bonuses of at least 1 month's salary to employees during the 2026 Tet holiday and the following years. "If the company has good policies to care for employees, it can retain employees" - another worker added.

Regarding the incident, a representative of the Dong Nai Provincial Labor Federation said that the upper-level Trade Union has coordinated with functional agencies to organize dialogues with the company's Board of Directors and the Executive Committee of the grassroots Trade Union, but the Tet bonus is still not guaranteed according to the collective labor agreement that the two parties have signed. Therefore, the Provincial Labor Federation continues to coordinate to support grassroots trade unions in protecting the rights of union members and workers.
