Article 2 of Decree 178/2024/ND-CP amended by Clause 2, Article 1 of Decree 67/2025/ND-CP stipulates as follows:
"2. Amend and supplement Article 2 as follows:
Subjects of application
1. Cadres, civil servants, public employees, and people working under labor contracts in agencies, organizations, and units specified in Article 1 of this Decree and armed forces are directly affected by the implementation of organizational restructuring and administrative unit restructuring at all levels, including:
...
c) People working under labor contracts for certain types of jobs in administrative agencies and public service units as prescribed by law before January 15, 2019 and people working under labor contracts are subject to policies like civil servants;
At Point c, Clause 3, Section II of Official Dispatch 1814/BNV-TCBC in 2025, guiding the implementation of Decree 178/2024/ND-CP and Decree 67/2025/ND-CP issued by the Ministry of Home Affairs, it is mentioned:

c) For those working under the labor contract regime as prescribed in Point c, Clause 1, Article 2 of Decree No. 178/2024/ND-CP (amended and supplemented in Decree No. 67/2025/ND-CP)
- Employees working in agencies, organizations, and units due to organizational arrangement and having signed labor contracts under Decree 68/2000/ND-CP before January 15, 2019 (the effective date of Decree 161/2018/ND-CP dated November 29, 2018 of the Government), who are transferred to sign labor contracts under Decree 161/2018/ND-CP, Decree 111/2022/ND-CP, are subject to the provisions of Point c, Clause 1, Article 2, Decree 178/2024/ND-CP (amended and supplemented in Decree 67/2025/ND-CP dated March 15, 2025).
- Employees working in agencies, organizations, and units due to organizational arrangement and having signed labor contracts under Decree 68/2000/ND-CP before January 15, 2019 and having terminated their labor contracts ( stopping work and not paying social insurance in agencies, units of the Party, State, or socio-political organizations); then signing labor contracts under Decree 161/2018/ND-CP or Decree 111/2022/ND-CP after January 15, 2019, are not subject to the provisions of Point c, Clause 1, Article 2, Decree 178/2024/ND-CP (amended and supplemented in Decree 67/2025/ND-CP).
Thus, employees who sign contracts under Decree 68/2000/ND-CP at agencies, organizations and units before January 15, 2019, who are transferred to sign contracts under Decree 161/2018/ND-CP and Decree 111/2022/ND-CP and are affected by the organizational arrangement, will be subject to Decree 178/2024/ND-CP amended and supplemented by Decree 67/2025/ND-CP.
However, employees working in agencies, organizations, and units due to organizational arrangement and having signed labor contracts under Decree 68/2000/ND-CP before January 15, 2019 but having terminated their labor contracts and then signed labor contracts under Decree 161/2018/ND-CP or Decree 111/2022/ND-CP after January 15, 2019 are not subject to Decree 178.
According to Decree 68 (expired from February 22, 2023), there are 6 groups of jobs that are contracted to contract 68, including: Repair and maintenance for electricity, supply and drainage systems at work, cars and other machinery and equipment being used in agencies and non -business units; drive; protect; toilet; Keeping vehicles of cadres, civil servants and guests coming to work with agencies and non -business units; Excess work, other service requires training level from intermediate or less.
