
Currently, the situation of intellectual property rights infringement, production and trading of counterfeit and fake goods is still posing many challenges to market management as well as brand protection and innovation activities of enterprises. Before the requirement to strengthen the fight against violations, many solutions have been synchronously implemented nationwide.
On May 5, the Prime Minister issued Official Dispatch No. 38 on focusing on directing the drastic implementation of solutions to combat, prevent, and handle acts of intellectual property rights infringement. On May 6, the Ministry of Science and Technology issued Decision No. 2309 attached to the Action Plan to implement Official Dispatch No. 38.
On the morning of June 1, information about this content, Mr. Tran Le Hong - Deputy Director of the Intellectual Property Office (Ministry of Science and Technology) said that the Ministry has established a mechanism to urge and summarize quick daily reports on the situation of handling violations nationwide in order to promptly provide information to serve the direction and administration of the Government and the Prime Minister.
Number of cases handled increases sharply after Telegram 38
As of May 27, ministries, branches and localities have detected 1,438 cases of intellectual property rights infringement. Among these, 1,146 cases were administratively handled and 28 cases were criminally prosecuted. The total amount of fines for intellectual property rights infringements is 12.6 billion VND. The value of violating goods is nearly 36 billion VND.
Functional forces also discovered nearly 30 serious, complex and typical violations.

After 3 weeks of launching, the number of administrative violations handled has been about 3 times higher than the average of one month in 2025. The number of criminal cases prosecuted related to acts of intellectual property infringement is about 60% of the total number of cases prosecuted in 2025," Mr. Hong said.
According to representatives of the Intellectual Property Office, many localities have established inter-sectoral working groups, strengthening coordination between the police force, market management, customs and related agencies in inspecting, detecting and handling violations.
The Intellectual Property Office also strengthens support for enforcement agencies, provides professional opinions to serve the handling of cases of intellectual property rights infringement, industrial property rights and publicizes focal points to support search, coordinate to provide information to serve the handling of violations.
Building a national database on the enforcement of intellectual property rights
Mr. Tran Le Hong said that the Ministry of Science and Technology is coordinating with relevant ministries and sectors to build a national database on the enforcement of intellectual property rights in 2026.
Through summarizing daily reports, the Ministry is forming an initial data source on the situation of detecting and handling violations of intellectual property rights nationwide.
It is expected that the database will gradually integrate information on handling administrative and criminal violations; typical, serious, and complex cases; information about intellectual property rights objects; results of appraisal and handling of violations by enforcement agencies nationwide.
According to a representative of the Intellectual Property Office, when built and operated, the database will support enforcement agencies to look up, share and compare information faster. This will also be a tool to serve statistics and forecast trends of intellectual property rights infringement acts to serve as a basis for planning the operations of enforcement agencies.
Regarding the completion of the legal corridor, Mr. Tran Le Hong said that Decree No. 186 amending and supplementing a number of articles of Decree No. 99/2013 has supplemented the authority to sanction administrative violations in the field of industrial property for a number of agencies to avoid gaps in tasks and closely monitor the area to accelerate the process of detecting and handling violations.
The Decree also supplements a remedy measure to prevent access to domain names infringing industrial property rights in order to speed up the process of handling violations and overcome difficulties in handling international domain names provided by units without headquarters in Vietnam.
