Resolution No. 01/2020/NQ-HDND of the People's Council of Lang Son province (effective from April 10, 2020) stipulates support policies for cadres and civil servants of communes, wards and towns; part-time workers at the commune level; part-time workers in villages, hamlets, residential groups, neighborhoods, blocks... organized below the commune level who are redundant due to the rearrangement of administrative units; arrangement and merger of villages and residential groups and arrangement and restructuring of the cadres and civil servants at the commune level, part-time workers at the commune level, in villages and residential groups in Lang Son province.
Part-time workers in villages and residential groups who receive monthly allowances and positions that receive monthly support in surplus villages and residential groups are among the subjects of the Resolution.
The Resolution provides one-time support for the above redundant subjects who have quit their jobs, with the specific support levels as follows:
a) Having worked for 5 years or less: 3 months of support according to the allowance or support level of the position at the time of resignation. In case of holding multiple positions, only the position with the highest allowance or support level will be counted;
b) From the sixth year onwards, for every 30 months of continuous service, the employee will receive an additional month of the monthly allowance or support level of the position before retirement. In case the service period has an odd number of months less than 30 months, the support level will be rounded up based on the principle that less than 16 months will be calculated as ½ month of the allowance or support level, from 16 months or more will be calculated as 1 month of the allowance or support level; the interrupted service period will not be counted as continuous service period and the work periods will not be added together to calculate the total service period receiving support;
c) The total one-time support level according to Point a and Point b of this Clause shall not exceed 6 months of the allowance or monthly support level of the position at the time of resignation for one support level/person;
d) In case the total support fund/beneficiary is lower than the basic salary, the minimum support level equivalent to 1 month of basic salary according to Government regulations at the time of resignation is received for one support/person.
According to Decree No. 33/2023/ND-CP (regulations on commune-level cadres, civil servants and part-time workers at the commune level, in villages and residential groups), part-time workers in villages and residential groups with no more than 3 positions (including Party cell secretary, village or residential group head, head of the Fatherland Front Working Committee) are entitled to monthly allowances. In case the Law has other provisions, the provisions of that Law shall apply.
Thus, the Village Chief is a non-professional person in the village. Therefore, if he is redundant due to the administrative unit arrangement in Lang Son, he will receive the support level according to the above regulations.
