Mr. Phan Van Bay (name of the character changed) said that he has studied Regulation No. 368-QD/TW but still does not clearly understand how to apply it to his case.
According to him, Regulation 368 ranks members of the Executive Committee of the Party Committee of communes, wards, and special zones at rank 9, in the same group as the position of head of professional departments and equivalents under the commune-level People's Committee.
Meanwhile, the Deputy Head of the Economic - Budget Committee of the Commune People's Council belongs to rank 10, in the same group as the position of deputy head of department and equivalent under the Commune People's Committee.
Mr. Bay said that he is currently a member of the Executive Committee of the Commune Party Committee, and also holds the position of Deputy Head of the Economic - Budget Committee of the Commune People's Council (specializing).
According to him, if determined according to the title of Member of the Party Committee Executive Committee, a 100% ratio will be applied, and if determined according to the title of Deputy Head of the Economic - Budget Committee of the Commune People's Council, a 50% ratio will be applied.
From there, Mr. Bay requested the Ministry of Home Affairs to clarify whether his case was determined according to the title of Member of the Executive Committee of the Commune Party Committee to be ranked at rank 9, in the same group as the title of head of commune-level department or not.
Regarding Mr. Bay's proposal, the Ministry of Home Affairs has responded on the Electronic Information Portal.
The 2025 Law on Cadres and Civil Servants stipulates: The determination of positions and titles equivalent in the political system shall be carried out in accordance with the regulations of competent authorities.
The transfer, rotation, training, fostering, evaluation, dismissal, resignation, dismissal and other contents related to personnel work are carried out in accordance with the law and competent authorities.
On September 8, 2025, the Politburo issued Regulation No. 368-QD/TW on the list of positions, groups of positions, and leadership positions of the political system.
Therefore, the Ministry of Home Affairs requests him to contact the competent authority managing his workplace for guidance.
