According to Resolution No. 220/HD-UBND of Bac Kan province (effective from April 20, 2021), the conditions for the Deputy Military Commander of the commune to retire and receive a one-time allowance are as follows:
Since the Law on Militia and Self-Defense Forces 2019 took effect (July 1, 2020), the subjects are Deputy Commanders of communes and towns who, during their working time, have participated in compulsory social insurance, have not participated in compulsory social insurance (from 2016 onwards, they are eligible to participate in social insurance) if they quit their jobs for the following reasons:
- Due to health not meeting job requirements;
- Due to difficult family circumstances (economic difficulties, single-parent family);
- Going abroad to settle down, no disciplinary violations;
- Surplus due to organizational and apparatus arrangement;
- Not yet trained as a Commander of the Military Command at the commune level in the basic military sector, with intermediate, college or university degrees at a Military school;
- Voluntarily resign and be considered and decided to resign by competent authority.
The above subjects are subject to policies according to the provisions of Clause 2, Article 33 of the 2019 Law on Militia and Self-Defense Forces and Point b, Clause 1, Article 8 of Decree No. 72/2020/ND-CP dated June 30, 2020 of the Government detailing a number of articles of the Law on Militia and Self-Defense Forces on the organization of force building and regimes and policies for militia and self-defense forces, specifically:
“In case of not participating in social insurance, having worked continuously for 60 months or more, when retiring, you will receive a one-time allowance, each year of work is calculated as 1.5 months of the average allowance of the last 60 months. In case of odd months, it is calculated as follows: Less than 1 month, no allowance is received; from 1 month to 6 months, you will receive an allowance equal to 0.8 months of the average allowance of the last 60 months; from 7 months to 11 months, you will receive an allowance equal to 1.5 months of the average allowance of the last 60 months”.
