The Ministry of Education and Training (MOET) is seeking comments on the draft Decree stipulating penalties for administrative violations in the field of education, which proposes penalties for violations of regulations on management and organization of tutoring and extra classes.
In the draft, the Ministry of Education and Training proposes a fine of 2 - 5 million VND for one of the following acts:
Teachers currently teaching at the school participating in extra tutoring outside the school who do not report, report incompletely or do not promptly update with the Principal about subjects, locations, forms of extra tutoring, relationships with the registered business entity of the extra tutoring facility, and extra tutoring time as prescribed;
Teachers currently teaching at the school untruthfully report about participating in extra classes outside the school or about their relationship with the entity registered to operate the extra teaching facility.
A fine of 5 - 10 million VND for one of the following acts:
Organizing extra classes in schools that are not for the right students to take extra classes according to regulations;
Organizing extra classes in schools exceeding the prescribed extra teaching time without the permission of the Director of the Department of Education and Training;
Classifying extra classes in schools with more than 45 students/class or not classifying extra classes by subject for each grade level;
Not publicizing the plan to organize extra classes and tutoring in schools as prescribed;
Part-time tutoring facilities that are inaccurately public or do not regularly update the contents that must be publicized before enrolling classes for part-time tutoring and extra classes according to regulations;
Do not specify the responsibilities and behaviors of teachers when participating in tutoring or managing tutoring and extra classes in the rules of conduct of teachers according to regulations.
A fine of 10 - 20 million VND for one of the following acts:
Teachers who are teaching at the school tutoring outside the school and collecting money from students who are assigned by the school to teach according to the school's education plan;
Teachers of public schools participate in managing and operating extracurricular activities outside the school;
tutoring or organizing tutoring for elementary school students outside of the permitted cases as prescribed;
Arrange extra tutoring hours in schools interspersed with the official schedule or tutor in advance of the content compared to the distribution of the subject program in the school's education plan;
Failure to set up or publicize hotline phone numbers to receive and process petitions and feedback on tutoring and extra classes according to regulations;
A fine of 20 to 30 million VND shall be imposed on organizations and individuals organizing extra classes outside the school for one of the following acts:
Arrange, sign contracts or agreements for teachers currently teaching at the school to give paid extra classes to students that teachers are assigned to teach by the school according to the school's education plan;
Arrange, agree or allow teachers of public schools to participate in managing and operating extracurricular activities outside the school;
Cutting teaching content according to the school's education plan to include tutoring;
Teachers of public schools participate in managing and operating extra classes outside the school;
Extra tutoring establishments, organizations, and individuals organizing extra tutoring outside the school take advantage of relationships with teachers who are teaching at the school to organize extra tutoring, causing conflicts of interest.
A fine of 30 - 50 million VND for one of the following acts:
Organize extra tutoring and extra classes outside the school with fee collection when not meeting business registration requirements according to the provisions of law;
Allow, arrange or agree to allow teachers of public schools to participate in managing and operating extracurricular activities outside the school;
Organizing extra classes and tutoring activities for profit, forcing students to take extra classes or entice students to take extra classes against regulations;
Continue to organize tutoring and extra classes after being requested by competent authorities to stop the violation.
In addition, the Ministry of Education and Training also proposed additional penalties including:
Suspend tutoring and extra classes for 01 month to 03 months for extra classes and extra tutoring locations that violate the provisions of Clause 4 of this Article;
Suspend tutoring and extra classes for 03 months to 06 months for extra classes, subjects, and extra tutoring locations that violate the provisions of Clause 5 of this Article;
Suspend tutoring and extra classes for 06 months to 12 months for tutoring establishments that violate the provisions of Clause 6 of this Article.
