Mr. Le Huu Nhiem said that he was transferred by the competent authority to work at the secondary school from April 2024.
At the time of transfer, Mr. Nhiem was holding the professional title of Grade II Primary School Teacher, code V.07.03.07 (teaching IT subject). His total working time with social insurance contributions is 6 years, the current salary coefficient is 3.00 (level 3).
Mr. Nhiem asked: "What professional title will I be appointed to when I transfer to junior high school? ".
The Ministry of Education and Training responds to this issue as follows:
In case a teacher has not been appointed to a professional title at the right level of education or changes his or her job position but the current professional title does not meet the requirements of the new job position, the head of the public service unit shall propose to the competent authority to decide on the consideration of transferring the professional title according to the provisions of Article 30 of Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government regulating the recruitment, use and management of civil servants and ensuring the principles prescribed in Clause 5, Article 5 of Circular No. 08/2023/TT-BGDDT. In which, it is necessary to pay attention to the following principles:
"a) Appointment to the professional title rank corresponding to the current professional title rank when meeting the standards of the appointed professional title rank and transfer to the salary coefficient equal to or higher than the most recent of the transferred rank according to the instructions in Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Ministry of Home Affairs guiding salary classification when upgrading, transferring ranks, transferring types of civil servants and public employees and according to current regulations of law;
b) When changing professional titles, it is not combined with promotion of professional titles, not combined with salary increase;
c) When changing the professional title, it is not required for civil servants to have a training certificate according to the professional title standards of the job position being transferred.
The Ministry of Education and Training also requested Mr. Le Huu Nhiem to provide supporting documents to the school principal so that the principal can propose to the competent authority to decide on the consideration of transferring the professional title from junior high school teacher to primary school teacher, ensuring compliance with regulations and ensuring his rights.
