The Ministry of Education and Training (MOET) said that the professional preferential allowance regime for teachers working in public educational institutions is implemented according to the provisions of Decree No. 182/2026/ND-CP dated May 22, 2026 of the Government.
Accordingly, the subjects of application include teachers, including those working under labor contracts in public educational institutions if the salary is applied according to the salary scale of civil servants.
In case Ms. T.C is a teacher working under a labor contract according to Decree No. 111/2022/ND-CP dated December 30, 2022 of the Government, the determination of whether she is eligible for professional preferential allowances or not needs to be based on the salary regime applied or agreed upon in the labor contract.
If applied or agreed to be ranked according to the salary scale of civil servants, they are eligible for professional preferential allowances according to regulations.
Regarding the bonus regime implemented according to the provisions of Decree No. 73/2024/ND-CP dated June 30, 2024 of the Government, people working under the labor contract regime specified in Decree No. 111/2022/ND-CP are subject to application if applied or have an agreement in the labor contract on salary ranking according to Decree No. 204/2004/ND-CP.
Therefore, determining whether they are eligible for the bonus regime or not also needs to be based on the salary regime applied or agreed in the labor contract.
The Ministry of Education and Training requests Ms. C to contact the educational institution where she is working to review the content of the labor contract and the current salary regime, as a basis for implementing regimes and policies in accordance with current regulations.
The evaluation and classification of the quality of cadres, civil servants, and public employees are carried out in accordance with the provisions of Decree No. 90/2020/ND-CP dated August 13, 2020 of the Government. The subjects of application of this Decree are cadres, civil servants and public employees. Because she is a teacher working under labor contracts according to Decree No. 111/2022/ND-CP, she is not subject to the application of Decree No. 90/2020/ND-CP on evaluation and classification of the quality of cadres, civil servants, and public employees.
