National Assembly deputies are still concerned about regulations on management of extra teaching and learning
On the morning of June 6, the National Assembly Standing Committee gave its opinion on the reception, explanation, and revision of the draft Law on Teachers.
Contributing opinions to the Draft Law on Teachers, Chairman of the Delegation Work Committee Nguyen Thanh Hai said that Article 11 of the Draft Law on Teachers stipulates the things that teachers are not allowed to do, including "forcing students to participate in extra classes in any form".

The Ministry of Education and Training has also issued Circular 29 on extra teaching and learning, which stipulates that teachers are not allowed to teach extra to students that they are directly teaching.
Ms. Hai noted that this is a step forward, clearly demonstrating the nature, extra learning and tutoring are legitimate needs, but not profitable.
However, how to ensure that profiteering cannot be avoided is the problem.
Everyone knows about extra teaching, but there are no specific regulations on the definition. There are currently 3 forms of extra teaching: Online, at home, at the center.
Recently, I have received a lot of information, since Circular 29 of the Ministry of Education and Training was issued, many teachers teach online, still teach main students and have money to collect, ... it is very difficult to manage" - Ms. Hai raised the issue.
The Chairman of the Delegation Work Committee also stated that in current regulations and Circulars, the phrase "no compulsory in any form" is used. According to Ms. Hai, the word "forced" has been around for many years but the question is still what is forced?
"Having specific written requests and registration is not compulsory. But in reality, there are cases where they are forced to voluntarily apply to go to school. The Ministry of Education and Training has accepted, accepted, and introduced many specific contents in the Circular, but there are variations. I want to have specific regulations in the law to avoid profiteering" - Ms. Hai said.
Why should teachers be banned from teaching regular students?
Contributing opinions and views on extra teaching and learning, Vice Chairman of the National Assembly Tran Quang Phuong said that it is necessary to use the word "not forcing" students to take extra classes.
He analyzed that there are many variations in what is called oppression, the important thing is how to manage to distinguish between "oppression" and "no oppression". "Not forcing extra classes" also means respecting the right to study of students and parents.
"A student in a class lesson can acquire 70% of their knowledge if that student has the ability. But there are also students who only get about 50%, 40% of the class and have to study by themselves, go to extra classes... Therefore, using the word "not forced" is appropriate" - Mr. Phuong said.
However, the Vice Chairman of the National Assembly expressed concern about the ban on teachers teaching their own students in class and recommended that it should be re- studied.
"If I banned them like that, now the students themselves said, "I don't want you to teach me more, but another teacher teaches me that I don't understand". So studying extra without registering for the teacher who taught me in class is very unreasonable. I am in charge of class 7A, I cannot let class 7A students take extra classes, which is unreasonable" - Mr. Phuong said and said that should not be banned.
Regarding the issue of managing extra teaching and learning that parliamentary delegates expressed their interest in, Minister Nguyen Kim Son said that Circular 29/2024 has clearly stipulated that this is a teaching and learning activity outside the school's educational plan for the purpose of conveying knowledge of the official curriculum, so it needs to be clearly regulated.
The Minister said that in the Draft Law on Teachers, the regulation on things that teachers are not allowed to do shows the view on teacher ethics, rather than a regulation of a professional nature.

Accordingly, teachers must complete the preparation of knowledge for students right in the regular class hours, if they do not complete this, the teacher will not fulfill their public duties.
"If these teachers continue to teach the contents of their public service responsibilities that they must do and bring them home, it will lead to changes that prevent teachers from fulfilling their public service responsibilities" - Minister Nguyen Kim Son affirmed.
For subjects such as: Students with poor academic performance, students preparing for the graduation exam, and fostering excellent students, teachers are allowed to teach extra classes in schools. This has also been clearly stipulated in Circular 29/2024 of the Ministry of Education and Training.
