The issue of salary and benefits, including seniority allowances for teachers, has always received the attention of many teachers and people.
Recently, the Ministry of Education and Training has received many questions related to seniority allowances, including a question from Ms. Pham Thi Hai Nhu.
Mr. and Mrs. Nhu have the following working time:
September 1981-2.1990: Work in the Vietnam People's Army (Level: Senior Lieutenant, salary: 350, seniority allowance of 8%);
March 1990 12.2012: Transferred to work at a state agency (the title is not included in seniority);
From January 2013 to present: Management staff ( Principal of Vocational College). During this time, Mr. and Mrs. Nhu directly participated in teaching according to regulations. In January 2013, this person was entitled to the main specialist salary until 2022, then he was ranked as a civil servant in the education sector V.09 (V.07) according to Decree No. 77/2021/ND-CP.
Ms. Nhu asked: "When will I be eligible for seniority as a teacher, from January 2013 or from the time I was ranked as a civil servant in the education sector in 2022? Is the seniority period for my brother and I during my military service calculated and what percentage is the seniority rate for teachers? ".
The Ministry of Education and Training responded to this issue on the Government Electronic Information Portal as follows:
The seniority allowance regime for teachers is implemented according to the provisions of Decree No. 77/2020/ND-CP dated August 1, 2021 of the Government. Accordingly, working time is counted for seniority allowances, including working time is counted for seniority allowances in the army, police, cryptography and working time is counted for seniority in other industries and professions (if any).
From January 2013 to before 2022, although he of Ms. Pham Thi Hai Nhu directly participated in teaching at public educational institutions, during this time his salary was arranged according to the Senior Specialist rank. Therefore, her brother is not eligible for seniority allowances for teachers during this period.
From 2022, when Ms. Nhu's brother was appointed to the professional title of education officer, his working time will be counted as the time to calculate seniority allowances for teachers according to current regulations.
At the time of starting to calculate seniority allowances for teachers, the time of service in the army before transferring to another major (belonging to the subjects calculated according to regulations) will be combined with the time working in the education sector to determine the total time used as the basis for calculating seniority allowances for teachers.
