Mr. Phan Ngoc Bach (Hai Phong) reflected that according to Clause 1, Article 13 of Circular No. 22/2021/TT-BGDDT, students with training results for the entire school year assessed as "Unsatisfactory" must practice during the summer vacation.
However, according to Article 14 of Circular No. 22/2021/TT-BGDDT, for students who are not eligible to be admitted to class but have training results for the whole school year assessed as "Avanced" or higher, the learning results for the whole school year assessed as "Unsatisfied" will be re-evaluated for the learning results of subjects assessed as "Unsatisfied" (for subjects assessed by comments) and subjects with an average score of less than 5.0 points (for subjects assessed by comments combined with scores).
Thus, Article 14 of Circular No. 22/2021/TT-BGDDT stipulates that the results of training for the entire school year do not include summer training, students must have a training result of "Excellent" or higher to be re-evaluated in their academic results.
According to Mr. Bach, Articles 12 and 14 are in conflict with each other and are not clearly regulated. He would like to be guided. In case students have "Unperformed" training results for the whole year, "Unperformed" learning results and have exercised during the "Dat" summer vacation or higher, will they be allowed to check and re-evaluate the subjects during the summer vacation or will they be left in class?
Regarding this issue, the Ministry of Education and Training responded as follows:
According to the provisions of Article 14 of Circular No. 22/2021/TT-BGDDT dated July 20, 2021 of the Minister of Education and Training on the assessment of junior high school students and high school students "For students who are not eligible for admission to class but have training results for the entire school year assessed at the Grade or higher, the learning results for the entire school year are assessed as Not achievable, then their learning results will be re-evaluated...".
At the same time, Clause 1 and Clause 3, Article 13 stipulate: "Students with training results for the entire school year are assessed as not achieving the level. If they do not meet the level, they must practice during the summer vacation. The training results after completion are included in the training results for the entire school year".
Thus, the results of training after students complete the training during the summer vacation are the official training results of the entire school year. This means that when students have initial training results at the level of "Not achieved", but after training in the summer if they meet the requirements ("Appearance" or higher), the training results for the whole year will be recorded as "Appearance" or higher.
Regarding the order and responsibility for organizing training and re-evaluating, according to Clause 2, 3, Article 13 and Clauses 2, 4, 5, Article 18 of Circular No. 22/2021/TTBGDDT: Principals of schools are responsible for organizing, guiding students to practice and re-evaluate training results; recording this result as a basis for consideration to class. The re-evaluation of learning outcomes (for the "Unperformed" subject) is carried out after the final training results are available, to ensure that students are qualified to practice, discipline, awareness and learning attitude according to regulations.
In case students have the results of training for the whole year at the "Unperformed" level and the learning results at the "Unperformed" level, students are trained during the summer vacation and are allowed to participate in the review and re-evaluation of subjects with "Unperformed" learning results according to Article 14 of the Circular. If the training results and learning results for the entire school year are assessed as "Appealing" or higher (including the re-evaluation results after training during the summer vacation) and do not take more than 45 classes off during the school year, students will be considered for promotion according to the provisions of Clause 1, Article 12 of Circular No. 22/2021/TT-BGDDT; if after re-evaluation, they still "Have not met" the requirements, students must stay in class as prescribed in Clause 3, Article 12.
