Mr. Doan Tran Hiep (Dien Bien) asked: "Are educational institutions with no source of revenue allowed to pay allowances for school health workers from the state budget?"
Mr. Hiep referred to Clause 6, Article 4 of Joint Circular No. 02/2012/TTLT-BYT-BNV-BTC stipulating the allowance level "For civil servants and public employees who do not directly perform medical expertise; civil servants and public employees who perform management and service work at public health service units (except for the subjects specified in Point c, Clause 5 of this Article), civil servants performing medical expertise at agencies, units, and schools, the head of the unit shall, based on the specific work and revenue sources, consider and decide to apply the allowance level specified in Clause 6, Article 3 of Decree No. 56/2011/ND-CP".
Article 4 of Decree No. 56/2011/ND-CP stipulates that "The source of funding to implement the allowance regime prescribed in this Decree is guaranteed by the state budget according to the current budget decentralization, the revenue of medical facilities from the units' career activities according to regulations and other legal sources of funding".
Section a, Clause 2, Article 5 of Joint Circular No. 02/2012/TTLT-BYT-BNV-BTC stipulates that "The funding source for implementing the allowance regime prescribed in this Joint Circular is guaranteed by the state budget according to the current budget decentralization, and the revenue of the medical facility from the unit's career activities according to regulations".
Regarding this issue, the Ministry of Finance responded on the Government Electronic Information Portal as follows:
