In the Draft Law on Teachers (3rd time) just announced by the Ministry of Education and Training, there are many new points about the authority and method of recruiting teachers.
According to current regulations, teacher recruitment has not been decentralized to the education sector (or assigned to schools) in many places, but is carried out by the internal affairs sector and the People's Committees at the district/province level. Recruitment is carried out according to the provisions of the Law on Civil Servants.
However, according to the proposal of the Ministry of Education and Training in the draft Law on Teachers, the education sector will be more proactive in recruiting teachers.
In Article 26 of the draft, the authority to recruit teachers is as follows:
- Private educational institutions, public educational institutions that self-insure regular expenses and investment expenses, and public educational institutions that self-insure regular expenses directly recruit teachers according to resolutions of the school council or university council;
- Public educational institutions that partially self-finance regular expenses and public educational institutions whose regular expenses are financed by the state budget directly recruit teachers according to recruitment plans approved by the education and training management agency directly managing that educational institution. In case the educational institution cannot organize recruitment, the education and training management agency directly managing that educational institution shall carry out the recruitment.
The Ministry of Education and Training also proposed that teacher recruitment be carried out through a method of reviewing applications, interviews and teaching practice.
Highly qualified people, talented people, people with special aptitude in the fields of culture, arts, sports, and traditional professions suitable for the teaching profession will be considered for special recruitment.
Recruitment principles must ensure publicity, fairness, objectivity and compliance with the law. No discrimination of ethnicity, gender, social class, beliefs, or religion; Ensure competitiveness, select the right people, meet the standards, and titles of teachers.
In addition, recruitment will also prioritize talented people, children of people with revolutionary contributions, children of teachers, ethnic minorities, volunteers working in ethnic minority and mountainous areas, especially disadvantaged communes in coastal areas, communes with especially difficult socio-economic conditions, island communes, border communes, safe zone communes according to Government regulations and other policy subjects.
As planned, the draft Law on Teachers will be submitted to the National Assembly for consideration and first comments at the 8th session (October 2024) and considered and approved at the 9th session (May 2025).
The Draft Law on Teachers has many new points related to the rights and obligations of teachers such as: Preschool teachers and teachers of schools for children with disabilities are allowed to retire 5 years earlier than prescribed; teachers still receive seniority allowances, other types of preferential allowances and are ranked with the highest salary in the administrative career salary scale.
Teachers working in disadvantaged areas and young teachers are supported with housing, training and development in some cases; the I, II and III rankings for teachers will be abolished and will be divided into the following categories: teacher, senior teacher and senior teacher; information about teachers' violations must not be made public without an official conclusion from a competent authority...
