The Draft Law on Teachers was drafted by the Ministry of Education and Training (MOET). The draft law has quite comprehensive and detailed provisions to improve the quality of teachers and protect the legitimate rights and interests of teachers.
One of the new points of the draft Law on Teachers that is receiving attention is the Ministry of Education and Training's proposal of regulations prohibiting organizations and individuals from engaging in certain behaviors related to teachers.
Accordingly, the Ministry of Education and Training has proposed six prohibited behaviors, ranging from banning insults to the honor and dignity of teachers to discriminating between them. This is to create a positive and fair working environment for teachers.
Regarding the above proposals of the Ministry of Education and Training, in the past, during the process of collecting opinions, many comments from localities and ministries and branches were received in the direction of support.
According to the summary of explanations and comments on the draft Law on Teachers, the Ministry of Education and Training said that many educational institutions and ministries participated in contributing comments on the regulations on the prohibited acts mentioned above.
Vinh University expressed its agreement with not disclosing information about teachers' violations until there is an official conclusion from the competent authority. This is to protect teachers.
At the working session with the National Assembly's Culture and Education Committee, many opinions suggested that additional regulations should be added to ensure information security for teachers. For example, not disclosing information about not being a teacher to create conditions for them to have the opportunity to do other jobs if they have previously committed violations.
The Ministry of Labor, Invalids and Social Affairs suggested that the Ministry of Education and Training consider and supplement detailed regulations on forms of handling violations and mechanisms to protect teachers from acts of violating their honor and dignity.
Many other opinions believe that it is necessary to have stricter regulations on prohibited acts of organizations and individuals against teachers, not only prohibiting acts of "insulting the honor, dignity, and violating the body of teachers", but also prohibiting acts and forms of psychological pressure and manipulation against teachers.
Some localities have proposed adding the act of not assigning work beyond the working hours prescribed by labor law without the teacher's consent.
In Clause 2, Article 13 of the draft Law on Teachers, there are 6 prohibited acts proposed for organizations and individuals. Details are as follows:
Insulting the honor, dignity, and violating the body of teachers;
Obstructing the professional activities of teachers;
Assigning teachers not in accordance with the agreement and commitment in the teaching contract;
Discrimination among teachers in any form;
Paying salaries not in accordance with the contract; not fully and promptly implementing the teacher's regime and policies as prescribed;
Disclose information about teachers' violations when there is no official conclusion from a competent authority during the process of considering discipline or prosecuting the teacher's legal responsibility and in cases where the violations are not serious enough to require revocation of the teaching license.
