Mr. Dang Tran Minh (An Giang) passed the entrance exam for high school equipment and testing staff in 2021, completed his internship in October 2021 and has been signed an indefinite contract to date, appointed to rank V.07.07.21.
Currently, Mr. Minh's school has a need to recruit teachers to teach fine arts. Mr. Minh asked, do you have a university degree in Graphic Design and a pedagogical professional certificate in Fine Arts at the high school level, can you be considered for transfer to the teacher rank to teach when the school has a need?
Regarding this issue, the Ministry of Education and Training answers as follows:
According to the provisions of Article 32 of the Law on Public Employees, when a public service unit has a need, public employees can be transferred to a new job position if they meet the professional and nghiep vu standards of that job position and carry out the change of professional title.
However, Article 29 of Decree No. 115/2020/ND-CP stipulates the cases of changing professional titles for civil servants including: "Considering transfer from this professional title to another professional title corresponding to the same level of work complexity as required by the job position".
The position of civil servant of equipment and testing requires a training level from college, while the position of high school teacher requires a training level from university and has a job nature different from the position of civil servant of equipment and testing.
The Ministry of Education and Training requests Mr. Dang Tran Minh to submit his wishes to the principal so that the principal can propose to the Department of Education and Training (if the school has a need for a position as a teacher teaching Fine Arts subject) to have a recruitment, use and management plan in accordance with the provisions of law.
