In Chapter IV of the Law on Teachers, Article 14 specifically stipulates the recruitment of teachers as follows:
1. Recruitment content and methods
a) Recruitment content based on teacher professional standards;
b) Recruitment method through admission or entrance exam, including pedagogical practice.
2. Recruitment authority
a) For public vocational training institutions and public higher education institutions, teacher recruitment is carried out by the head of the educational institution;
b) For non-public educational institutions, the recruitment of teachers is carried out by the head of the educational institution according to the regulations on organization and operation of the educational institution;
c) For schools of the People's Armed Forces, the authority to recruit teachers is prescribed by the Minister of National Defense and the Minister of Public Security;
d) For educational institutions not specified in Points a, b and c of this Clause, the authority to recruit teachers is prescribed by the Minister of Education and Training.
3. Priority subjects in teacher recruitment
a) People who have performed teaching and education tasks at job positions suitable for the job positions to be recruited;
b) For vocational education, priority is given to people with high vocational skills and experience in actual production, business and service in accordance with the industry and teaching profession;
c) Other cases of priority recruitment as prescribed by law.
4. People who are not allowed to register for recruitment
a) People with civil act capacity loss, limited civil act capacity or people with difficulty in perception, mastering behavior;
b) People being prosecuted for criminal liability; serving a court's criminal judgment or decision; being subject to the measure of being sent to a compulsory drug rehabilitation facility or a compulsory education facility;
c) People with a criminal record for violations of national security, crimes against human life, health, dignity and honor according to the provisions of the Penal Code.
5. Contracts for teachers include work contracts implemented in accordance with the provisions of the law on civil servants and labor contracts implemented in accordance with the provisions of the law on labor.
6. The Government shall detail Clause 1, Point a and Point b, Clause 2, Clause 3, Clause 4 of this Article; prescribe the conditions, order, and procedures for recruiting foreign teachers.
