The Ministry of Education and Training (MOET) is seeking opinions on a draft Decree regulating preferential allowances according to occupation for civil servants and employees working in public educational institutions.
When approved and issued, this Decree will replace Decision No. 244/2005/QD-TTg dated October 6, 2005 of the Prime Minister on preferential allowances for teachers who are directly teaching in public educational institutions.
Article 5 of the draft stipulates that civil servants and employees are not entitled to preferential allowances during the following periods:
During his working, working and studying abroad, he/she receives 40% of his/her salary according to the provisions of Clause 4, Article 8 of Decree No. 204/2004/ND-CP.
The period of continuous suspension of work is 1 month or more.
Time off work to receive social insurance benefits according to the provisions of the law on social insurance (except for sick leave and maternity leave according to the provisions of the Social Insurance).
Other leave exceeding the time prescribed by the Labor Code and the Law on Social Insurance.
In addition, the draft also stipulates preferential allowances for jobs, ranging from 15 - 80% depending on the subject and job position.
Notably, this is the first time that employees in schools have received allowances, specifically at a rate of 15% for support and service positions; 20% for shared professional titles; 25% for professional titles, to recognize their important role in the overall development of the education sector.
The 15% allowance is applied to civil servants and employees in the group of job positions working in support and service in public educational institutions.
The 80% allowance is applied to civil servants and employees working in preschool education institutions in areas with particularly difficult socio-economic conditions as prescribed by the Government;
In addition, teachers working and teaching in communes in region III of ethnic minority and mountainous areas, island communes, and border communes that have been recognized as meeting new rural standards according to the Prime Minister's Decision will continue to receive preferential allowances of this region for a period of 36 months from the date of approval by competent authorities.
The Ministry of Education and Training affirmed that the Draft Decree not only overcomes the shortcomings of current regulations but also demonstrates the deep concern of the Party and State for teachers and educational staff.
"The promulgation of the Decree will create a legal corridor for localities to implement policies in a synchronous and fair manner, contributing to improving the quality of education, retaining human resources and promoting the sustainable development of the Vietnamese education sector" - the Ministry of Education and Training informed.
