One of the new points in the draft Law on Teachers (3rd edition) recently announced by the Ministry of Education and Training (MOET) for comments is the regulation on the working regime of teachers (Clause 2, Article 32).
Accordingly, the third draft has stipulated many changes in the working regime compared to before. Educational management staff no longer have 8 weeks of summer vacation as in the second draft.
Teachers' annual leave includes annual summer vacation, holidays, Tet and other holidays as prescribed by the Labor Code.
Teachers' annual summer vacation time is specifically as follows:
The annual summer vacation for teachers of preschools, general education institutions, and specialized schools is 08 weeks, including annual leave;
The annual summer vacation for secondary school teachers and college lecturers is 06 weeks, including annual leave;
The annual summer vacation of university lecturers is implemented according to the regulations on organization and operation of the university;
The annual summer vacation of educational institution managers is flexibly arranged during the school year and during summer vacation to ensure normal operation of the educational institution;
In case of emergency, natural disaster prevention, epidemic prevention or urgent cases, summer vacation time for teachers of preschools, general education institutions, specialized schools, secondary schools and colleges is decided by the Minister of Education and Training, Minister of Labour, War Invalids and Social Affairs according to their authority.
The working regime of teachers is specifically defined as follows:
The working regime of preschool teachers is calculated according to the converted working hours/day to ensure working hours/day according to regulations, other activities are calculated according to actual participation time according to administrative hours;
Teachers holding management positions in educational institutions must work 40 hours/week and must directly teach according to regulations.
Teachers are arranged to take compensatory leave or paid overtime when actual working time exceeds the prescribed working time limit.
The Minister of Education and Training, Ministry of Labour, War invalids and Social Affairs, within the scope of assigned tasks and powers, shall specify in detail the working regime for teachers.
