After the Minister of Education and Training (MOET) signed and issued Circular 29/2024/TT-BGDDT regulating extra teaching and learning, effective from February 14, 2025, many people expressed concern about whether, in addition to teachers, vice principals who want to teach extra classes need to ask for permission from the principal.
Article 6 of Circular 29/2024/TT-BGDDT stipulates extra teaching and learning outside of school as follows:
Organizations or individuals that organize extra-curricular teaching and learning activities outside of school that collect fees from students (hereinafter referred to as extra-curricular teaching facilities) must comply with the following requirements:
Register business according to the law
Publicly announce on the electronic information portal or post at the location of the tutoring facility the subjects that are taught extra; the duration of extra teaching for each subject according to each grade level; the location, form, and time of organizing extra teaching and learning; the list of tutors and the tuition fees before enrolling students in extra teaching and learning classes.
Extracurricular tutors must ensure good moral qualities and professional competence appropriate to the subjects they teach.
Teachers who are teaching at schools and participate in extra-curricular teaching must report to the Principal or Director or head of the school about the subjects, location, form, and time of extra-curricular teaching. This Circular aims to increase the management responsibility of the Principal for teachers under his/her management when participating in extra-curricular teaching outside of school.
Also according to the provisions of the new circular, organizations and individuals organizing extra teaching and learning outside of school that collect fees from students must register their business to be subject to management under the provisions of the Enterprise Law.
The level of tuition fees for extra-curricular study outside of school is agreed upon between the parents, the student and the tutoring facility. The collection, management and use of tuition fees shall comply with the provisions of the law on finance, assets, accounting, taxes and other relevant regulations.
Accordingly, Circular 29/2024/TT-BGDDT did not mention whether a Vice Principal who wants to teach extra classes needs to ask for permission from the Principal or not.
Previously, Article 5 of the latest draft Circular on extra teaching and learning in 2024 clearly stated that teachers (including Vice Principals or deputy heads) receiving salaries from the salary fund of general education institutions or public continuing education institutions who participate in extra teaching outside of school must fully comply with the requirements.
At the same time, if the vice principal wants to teach extra classes, he/she must report to the principal about the subject, location, time of extra classes and commit to completing the assigned tasks, not violating the rules of extra teaching and learning.
In case there are students in the extracurricular class that they are directly teaching in school, they must report and make a list of those students (full name of students; class in school) to the Principal and commit not to use any form of forcing students to take extra classes.
