The above content is stated in the Draft Resolution on the allowance regime for preschool teachers who have retired from work and have not yet enjoyed the regime.
In the draft, the Ministry of Education and Training said that, according to reports from provinces and cities directly under the Central Government, there are over 120,000 preschool teachers nationwide who have worked but have not received benefits, concentrated in provinces from Quang Binh (old) to the North.
These teachers have participated in teaching and working at nurseries, kindergartens, and beginners classes in production teams, cooperatives, farms, forestry farms, enterprises... belonging to communes, wards, villages, hamlets, rural and forestry farms...; the subjects of teaching are children of commune members, workers, cadres, soldiers participating in the resistance war, labor...
Many teachers entered the industry in the 1960s, with a working period of 20 to 30 years. Preschool teachers in this period were all paid with rice (in the 1980s, they were paid about 10 kg of rice/month, in the 1990s, they were paid about 20 kg of rice/month) or remuneration contributed voluntarily by parents (in the 1990s, they were paid about 40,000 - 50,000 VND/month).
These teachers when they retire from work do not enjoy any regimes or policies of the state even though they have worked and contributed to the profession, to children and experienced the most difficult and painful times of the country when the two regions of the country were divided. While some subjects who participated in combat and production during the period when the country was still at war have been concerned by the State to resolve regimes and policies.
Although, on August 18, 2011, the Prime Minister issued Decision No. 45/2011/QD-TTg on regulations on partial support for voluntary social insurance contributions for preschool teachers who have worked before 1995 but are not eligible for retirement benefits, however, for many reasons, many teachers have not been compensated or compensated but still do not meet the conditions to receive pensions...
On January 24, 2020, the Government issued Decree No. 14/2020/ND-CP stipulating the allowance regime for retired teachers who have not yet received seniority allowance in their pensions, however, this Decree only applies to teachers who retired in the period from January 1, 1994 to May 31, 2011.
Therefore, many preschool teachers who retired before 1995 do not meet the conditions to enjoy the allowance regime according to Decree No. 14/2020/ND-CP" - the Ministry of Education and Training stated the reality.
Based on the above grounds, the Ministry of Education and Training proposes to develop a Resolution on allowance regimes for preschool teachers who have retired from work and have not yet enjoyed the regime.
The draft applies to preschool teachers who have worked before January 1, 1995, have retired but have not received pensions or the working period before 1995 is not counted to receive pensions, and have not yet enjoyed the regime according to Decree 14/2020/ND-CP.
According to the draft, preschool teachers who have documents proving that their working time is 3 years or less will receive a one-time allowance of 6.5 million VND; from the 4th year, each year of work will be added 800,000 VND, and in odd months of 30 days, 67,000 VND will be added.
In case the working time cannot be determined, there are no documents to prove it, they have received a one-time allowance before or the working time before 1995 is not counted for pension, they are entitled to a one-time allowance of 6.5 million VND. If there is both a determined time and no determined time, the determined time is only counted. In case the teacher has passed away or lost civil act capacity, relatives or guardians are entitled to receive the allowance.
With the viewpoint when drafting the Resolution that the allowance regime for the team of preschool teachers who have retired from work is paid similarly to people with meritorious services, but at a lower level, the Ministry of Education and Training proposes a plan that the first 3 years of work will be entitled to a level equivalent to 2.5 times the base salary at this time (calculated at about 6,500,000 VND) and then increase by 800,000 VND each year.
The state budget needs to supplement about 1,200 billion VND" - the Ministry of Education and Training stated the impact.
