The Ministry of Education and Training (MOET) issued Circular No. 05/2025/TT-BGDDT (Circular No. 05), effective from April 22, 2025, regulating the working regime for general education and university residents.
This Circular replaces Circular No. 28/2009/TT-BGDDT dated October 21, 2009 of the Ministry of Education and Training promulgating regulations on working regime for general education teachers.
The Circular supplements regulations on annual leave for principals and deputy principals. Accordingly, principals and vice principals have summer vacation like teachers, this summer vacation is arranged flexibly during the school year and during the summer vacation. However, to ensure normal operation of the school, to avoid the case where all management staff are off at the same time, the summer vacation schedule of the management staff must be reported to the management agency.
Supplementing regulations on maternity leave for teachers, including regulations on maternity leave coinciding with summer vacation.
For female teachers whose summer vacation (before maternity leave) or the remaining summer vacation (after maternity leave) is no longer or less than the annual leave period as prescribed by the Labor Code, teachers will be arranged for additional days off to ensure the total number of days off or the number of remaining days off and the number of days off is equal to the number of days off per year as prescribed by the Labor Code (Clause 2, Article 6).
Currently, teachers' summer vacation is implemented according to the provisions of Decree 84 of 2020 of the Government. The total number of days off for high school teachers is 8 weeks, including annual leave.
In case of emergency or emergency to prevent natural disasters, epidemics or emergency cases, the summer vacation time is decided by the Minister of Education and Training according to his authority.
In addition to the regulation on summer vacation, the new Circular also stipulates the working time of the principal and deputy principal in the year with 42 weeks.
Of which, the number of weeks of teaching content in the general education program is 37 weeks. The number of weeks of studying and training to improve qualifications is 3 weeks. The number of weeks to prepare for the new school year and summarize the school year is 2 weeks.
