Lao Cai province has just proposed to amend Point b, Clause 2, Section II of Circular No. 09/2005/TT-BNV to conform with the Circular regulating the summer vacation regime for teachers.
Responding to this proposal of Lao Cai province, the Ministry of Home Affairs said that, based on Clause 4, Article 6 of Decree No. 204/2004/ND-CP: "Applicable to subjects working on islands far from the mainland and border areas with especially difficult living conditions", the Minister of Home Affairs issued Circular No. 09/2005/TT-BNV;
In which, the Ministry of Home Affairs affirmed that point b, clause 2, Section II stipulates: "Special allowance is only paid for months of actual work in the area. When leaving the area for one month or more or working for less than a full month, it is not entitled to receive" is consistent with the current salary regime.
According to Lao Dong's research, regarding the allowance level, Circular 09 also clearly states: Special allowance is calculated as a percentage of the current salary plus leadership position allowance and seniority allowance beyond the framework (if any) or current military rank allowance for non-commissioned officers and soldiers in the armed forces.
The allowance includes 3 levels: 30%; 50% and 100% applied to subjects specified in Section I of this Circular working in the areas specified in the appendix issued with this Circular.
Regarding the source of funding for paying special allowances, according to this Circular, subjects belonging to agencies and units are fully guaranteed by the state budget. Special allowances are paid by the state budget according to the current budget decentralization in the budget estimates assigned annually to agencies and units;
Subjects belonging to agencies implementing payroll and administrative management budget contracts and subjects belonging to public service units implementing financial autonomy, special allowances are paid by agencies and units from contracted budget sources and autonomous financial sources.
