The Ministry of Education and Training (Education and Training) has just issued Circular No. 05/2025/TT-BGDDT (referred to as Circular 05), effective from April 22, 2025. This Circular stipulates the working regime for high school teachers and teachers of preparatory schools.
Circular 05 officially replaces Circular No. 28/2009/TT -BGDDT dated October 21, 2009 - This is a document that has been applied for the past 16 years. One of the notable new points of this circular is to supplement the annual resting time for the principals and vice principals of high schools.
Specifically, the principal and the Vice Principal will be on vacation as a teacher, with a flexible break time during the school year and summer vacation. However, in order to ensure the stable operation of the school, the rest schedule of managers must be reported and agreed with the management agency, avoiding the situation of the entire management board at the same time.
For teachers, the annual summer vacation period is 2 months, including the time of leave as prescribed by the Labor Code 2019. During this time, the teacher still enjoys the salary and allowances (if any).
Compare according to the latest circular of the Ministry of Education and Training does not specify the summer vacation regime with school staff. The school staff is determined to be an educational career official, the working regime will comply with the office time frame and the provisions of working time and rest according to the Labor Code.
In case of a vacation in the summer, the school staff must have the consent of the principal and the break time must be in accordance with Articles 113 and 114 of this Code.
According to the Labor Code, the employee working for 12 months for a employer will be off every year and enjoy the salary. Specifically:
12 working days for work under normal conditions
14 days for minors, disabled people or working in heavy, hazardous and dangerous environments
16 days for those who work or are particularly heavy, hazardous and dangerous.
In addition, every 5 years of work continuously, workers are given 1 more annual leave.
Accordingly, the school staff will not get a long summer vacation as a teacher, but there is still an annual leave regime in accordance with the current labor law.
