During summer vacation, whether teachers are allowed to participate in extra teaching outside of school or not is a question that many teachers ask. Here is some information on regulations on extra teaching for teachers to note.
Regulations on extra teaching and learning
Currently, according to the provisions of Article 6 of Circular 29/2024/TT/BGDDT, teachers are allowed to teach extra classes outside of school during the summer vacation but must report to the Principal or Director or head of the school (collectively referred to as the Principal) about the subject, location, form, and time of participation in extra classes.
For teachers who organize extracurricular activities and collect money from students, they must fulfill the following requirements:
Registering a business in accordance with the provisions of law
Publicly on the electronic information portal or listed at the place where the tutoring institution is headquartered on the subjects that are organized for tutoring; the duration of tutoring for each subject according to each grade; location, form, time of organizing tutoring and tutoring; list of tutors and tuition fees before enrolling in tutoring classes.
Teachers who teach extra classes outside of school must ensure good moral qualities; have professional capacity suitable for the subjects they teach.
Previously, the Ministry of Education and Training (MOET) issued Circular No. 29/2024/TT-BGDDT regulating extra teaching and learning. This Circular replaces Circular No. 17/2012/TT-BGDDT dated May 16, 2012. Circular 29 officially takes effect from February 14, 2025.
Are general education teachers entitled to salary during summer vacation?
Clause 3, Article 5 of Circular 28/2009/TT-BGDDT stipulates as follows:
- Working time, annual leave
Teachers' annual leave includes: summer vacation, Lunar New Year holiday, semester vacation and other holidays, specifically as follows:
Teachers' summer vacation is 2 months, instead of annual leave, and they are entitled to full salary and allowances (if any)
Lunar New Year and school holidays are regulated by the Minister of Education and Training.
- Other holidays as prescribed by the Labor Code
Based on the school year plan, scale, characteristics, and specific conditions of each school. The principal arranges annual leave for teachers appropriately in accordance with regulations.
Accordingly, teachers have a summer vacation instead of annual leave of 2 months and are entitled to full salary.
