Working hours can be agreed upon flexibly
According to Circular No. 59/2026/TT-BGDĐT, the signing of contracts with teachers after retirement must ensure the principles of voluntariness, equality, publicity, and transparency.
This needs to be consistent with the development needs of the teaching staff of educational institutions, and at the same time not affect the recruitment and training plan for successor teachers.
For teachers who are signed full-time employment contracts after retirement, working hours and rest are implemented according to the agreement in the labor contract, on the basis of complying with the provisions of labor law and the working regime of teachers issued by the Minister of Education and Training.
Educational institutions and teachers are also proactively and flexibly agreed upon in terms of form, working hours and rest hours.
The agreement must ensure compliance with the age and health of teachers, in order to maximize their capacity and experience in teaching and scientific research, and at the same time comply with the provisions of labor law for elderly workers.
What rights do retired teachers have to continue teaching?
Teachers who sign full-time employment contracts after retirement are paid salaries, allowances and other benefits corresponding to the results and products according to the agreement in the contract and the provisions of law.
This group of teachers is also respected and protected in terms of prestige, honor, and dignity; and is treated equally in their activities and professional development.
When teaching at educational institutions, teachers are entitled to exercise their rights according to the provisions of law.
Notably, teachers after retirement can still be considered for appointment to professor and associate professor titles; considering and awarding the titles of People's Teacher, Meritorious Teacher and other emulation titles if they fully meet the standards and conditions according to the provisions of law and regulations on organization and operation of educational institutions.
Teachers also have the right to unilaterally terminate labor contracts according to the provisions of labor law. Parties are prioritized to agree on the time of prior notice and the time of contract termination in accordance with the teaching and training plan of the educational institution.
Salary and allowances are implemented according to the agreement
According to regulations, salaries, allowances and other benefits of full-time contract teachers after retirement are implemented according to the agreement in the labor contract and the provisions of law.
The payment of allowance items such as seniority allowances, professional preferential allowances or other specific supports is also carried out on the basis of agreements between the parties in the contract.
These agreements aim to recognize the professional qualifications, practical experience and contributions of teachers to educational institutions.
The deduction and payment of personal income tax are carried out in accordance with the provisions of current tax and financial laws.
