On April 28, the People's Committee of Thanh Hoa province announced that the Provincial People's Committee has just issued Decision No. 40/2025/QD-UBND regulating extra teaching and learning in the province. The decision takes effect from May 6, 2025, replacing Decision No. 2381/2012/QD-UBND.
According to the new regulations, extra teaching and learning activities are organized for general education and continuing education, requiring strict management from the commune, district level to the department of education.
Extra teachers, extra learners, organizations and individuals involved must comply with regulations on registration of activities, financial management, tax obligations and be subject to inspection and examination by competent authorities.
The regulation emphasizes the principle of publicity and transparency in the management and use of tuition and tutoring funds. For public schools, the collection and use of funds must be approved by the School Council and civil service conferences and included in internal spending regulations.
The cost of extra teaching is paid to teachers, management, electricity and water costs, purchase and repair of facilities for extra teaching and learning activities.
Principals of public schools are responsible for planning the funding needs for organizing extra classes and tutoring right from the beginning of the school year, and proposing that the superior management agency arrange appropriate funding sources.
The principal must also be fully responsible before the law and the Provincial People's Committee for violations related to extra teaching and learning activities in schools and by teachers under their management.
For extra-curricular teaching institutions, the collection and expenditure of funding shall be implemented according to the agreement between the organizer and the extra-curricular teacher, ensuring compliance with legal regulations and tax obligations.
These facilities must undergo periodic or surprise inspections and checks by education management agencies and tax authorities.
The regulation also clearly states that public schools are not allowed to collect tuition and extra learning fees from students who are exempted from tuition fees or enjoy support policies according to the regulations of the Ministry of Education and Training.
The People's Committee at the district level is fully responsible for managing extra teaching and learning activities in the locality; granting business registration certificates to extra teaching institutions according to its authority; directing the Department of Education and Training to strengthen regular inspection and supervision. The People's Committee at the commune level is responsible for managing and supervising extra teaching and learning activities in the area.
The Thanh Hoa Department of Education and Training is assigned to preside over the implementation guidance, coordinate with the Department of Finance, tax authorities and related units in the work of inspection, examination and handling of violations of extra teaching and learning activities.
