Ms. Le Thi Thu Hien (Phu Tho) is a junior high school IT teacher, joined the profession in February 2011, entered the payroll in March 2012, current salary level is level 5, coefficient 3.66 (old level II junior high school code V.07.04.11).
Ms. Hien studied and received a certificate of professional title of secondary school teacher grade II in 2021. From 2023, she decided to transfer from secondary school to primary school, still teaching IT.
Up to this point, she is still receiving the old grade II salary of the junior high school level, and has not been transferred to the primary school teacher level. Ms. Hien asked, will she be transferred to the primary school teacher salary level? When transferred, what grade will she be assigned and what will her salary be? Does she still need to study to get a certificate of training in the professional title standards of primary school teachers because Circular No. 08/2023/TT-BGDDT stipulates that primary school teachers must have this certificate?
Regarding this issue, the Ministry of Education and Training responded on the Government Electronic Information Portal as follows:
Clause 1, Article 31 of the Law on Civil Servants stipulates the principle of appointing professional titles for civil servants as follows: "Working in a job position, the person shall be appointed to a professional title corresponding to that job position" and "The person appointed to a professional title must meet the standards of that professional title".
In case a teacher has not been appointed to a professional title appropriate to the level of education he/she is teaching or changes his/her job position and the current professional title does not match the requirements of the new job position, the head of the public service unit shall request the competent authority to decide on the transfer of professional title, according to the provisions of Article 30 of Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government regulating the recruitment, use and management of civil servants and ensuring the principles prescribed in Clause 5, Article 5 of Circular No. 08/2023/TT-BGDDT dated April 14, 2023 of the Minister of Education and Training amending and supplementing a number of articles of Circulars No. 01, 02, 03, 04/2021/TT-BGDDT dated February 2, 2021 of the Minister of Education and Training stipulating codes and standards for professional titles. and appoint and arrange salaries for teaching staff in public preschool and general education institutions.
Therefore, it is recommended that Ms. Le Thi Thu Hien contact directly with the competent authority to transfer the professional title of primary school teacher according to the local hierarchy to determine and carry out the appointment of the professional title in accordance with the job position she is holding.
In addition, Point c Clause 5 Article 5 of Circular No. 08/2023/TT-BGDDT stipulates: "When transferring a professional title, civil servants are not required to have a training certificate according to the professional title standards of the transferred job position".
After being appointed and transferred to a new professional title, if you want to register for an exam or be promoted to a higher professional title, you must have a training certificate according to the prescribed professional title standards.
