From 8:00 a.m. on August 13, the People's Committee of Phu Xuyen district (Hanoi) forcibly recovered land from 15 households in Phu Bat village (Hong Minh commune) with a total area of 1,930 m2 to implement the construction of the southern trunk road project.
After Chairman of Hong Minh Commune People's Committee Dang Quang Duy finished reading the decisions on land recovery enforcement, the district and commune's functional forces protected the area, cleared crops, and leveled the ground left by the authorities. Households do not comply.
Phu Xuyen District People's Committee then handed over the site to the investor to construct the project adjacent to the bridge over Van Dinh canal.
According to Phu Xuyen District People's Committee, the above 15 plots of land originated because the Commune People's Committee arbitrarily allocated and sold them illegally since 2008.
This land allocation violates land law and was handled by the Hanoi People's Court according to judgment No. 922/2016/HS-PT dated September 7, 2016.
At the time of land allocation, Hong Minh Commune People's Committee did not invest in building technical infrastructure, and households had fully fulfilled their financial obligations with the amount of 23,400,000 VND/household.
According to the provisions of Article 75 of the Land Law and decrees of the Government, there are no regulations on compensation or land support when the State recovers land in case of unauthorized land allocation after July 1, 2004, therefore , there is no basis to support these households, leading to them not agreeing to coordinate in site clearance.
Regarding this issue, Phu Xuyen District People's Committee has reported to relevant departments and branches.
On February 28, 2024, the Hanoi Department of Natural Resources and Environment issued Document No. 1300/STNT-KTĐ, affirming that there are no regulations on compensation or support for land when the State recovers land in case of unauthorized allocation. after July 1, 2004.
Phu Xuyen District People's Committee and Hong Minh Commune People's Committee have organized many propaganda, advocacy and dialogue sessions to help households understand the nature of the incident, coordinate with units to voluntarily clean up crops as well as assets on land to hand over the project construction site.
However, 15 related households did not comply.

Therefore, the District People's Committee has conducted forced land recovery to hand over the site to the investor to construct the project in accordance with the law" - leader of Phu Xuyen District People's Committee said.
The investment project to build the southern backbone of Hanoi (formerly called the investment project to build the southern backbone of Ha Tay province) has a length of more than 41km through Ha Dong, Thanh Oai, Ung Hoa and Phu Xuyen districts. .
The project has a total investment of 6,076 billion VND, implemented in the form of BT (build-transfer contract), starting construction in 2008.
After 16 years of implementation, the project section passing through Ha Dong district, Thanh Oai district and Ung Hoa district has basically been completed with a cross section of 40m, 6 lanes.
The rest goes through the communes: Hoang Long, Tri Trung, Phu Tuc, Chau Can of Phu Xuyen district, which is still under construction. Particularly, the section passing through Hong Minh commune has been "stagnant" for many years because of land clearance problems.
