According to Official Dispatch No. 1767/BTC-TCCB in 2025, the Ministry of Finance guides the implementation of Decree 178/2024/ND-CP on the implementation of early retirement policies in the process of restructuring the apparatus and streamlining the payroll.
However, not everyone is eligible for consideration. Some groups of subjects will not be able to settle their early retirement benefits, even if they have a voluntary application and have worked for many years.
Three groups of subjects excluded from the early retirement policy include:
- Women who are pregnant, on maternity leave or raising children under 36 months old: This is a group with special protection according to the provisions of labor law. However, if the individual has a voluntary application, it can still be considered.
- People who are in the process of being disciplined, prosecuted for criminal liability or being inspected or examined with signs of violations: The violation being considered makes these individuals not eligible to enjoy humane policies such as early retirement.
- People with 2 consecutive years of being classified as not completing tasks: This is an important new point, reflecting the orientation to improve the quality of the team. The prolonged poor classification will mean a loss of access to early retirement support policies.
In addition, in the guiding document, the Ministry of Finance also clearly stipulates: the consideration of early retirement is only calculated within 12 months from the effective date of the document on organizational arrangement issued by competent authorities.
If the retirement application is submitted after this time, employees will no longer enjoy the preferential policies as in the first 12 months. Instead, policies will be applied in the later stages, possibly lower.
The early retirement policy under Decree 178 is designed to create conditions for those who are eligible and wish to withdraw early during the streamlining process, while screening cases that do not meet the requirements for capacity and public ethics.
