Mr. Nguyen Hoang Long (Hanoi) said that a project using local education capital has a design consulting package value of about 30 million VND.
Mr. Hoang Long asked: "Based on Point m, Clause 1, Article 23 of the 2023 Law on Bidding, this is not an investment project under the Law on Public Investment, is not included in the procurement budget, and is not included in the conditions for designated bidding under other provisions. I would like to ask, what form of contractor selection is used for similar projects?".
Regarding this issue, the Ministry of Planning and Investment responded on the Government Electronic Information Portal as follows:
According to Point m, Clause 1, Article 23 of the Bidding Law No. 22/2023/QH15, bidding packages under the procurement estimate have a package price within the limit of over 50 million VND to 100 million VND; bidding packages under investment projects of state-owned enterprises, enterprises in which state-owned enterprises hold 100% of charter capital and investment projects under the Law on Public Investment, including: Bidding packages for providing consulting services with a package price within the limit of not more than 500 million VND, non-consulting, goods, construction and installation, mixed bidding packages with a package price within the limit of not more than 1 billion VND.
Thus, for bid packages not belonging to investment projects under the Law on Public Investment, the limit for designated bidding according to the procurement estimate will be applied from over 50 million VND to 100 million VND (for bid packages, the procurement content has a price not exceeding 50 million VND, the head of the purchasing agency or unit is responsible for deciding on the procurement to ensure savings and efficiency and is responsible for his/her own decisions without having to prepare, appraise, and approve the contractor selection plan, the bid package estimate, and not having to sign a contract with the supplier but must ensure a complete invoice and document regime according to the provisions of law).
