The company's land is located at lot 1/20A Le Hong Phong Street, Nga Nhau Urban Area - Cat Bi Airport, Ngo Quyen District.
Accordingly, EIE Tourism and Investment Co., Ltd. (Eie Company) disagrees with Decision 4511/QD-UBND dated December 29, 2022 of Hai Phong City People's Committee on recalling 13,524.9m2 of land under the Eie Trade Center investment project at Lot 1/20A Le Hong Phong Street, Dang Giang Ward, Ngo Quyen District for Eie Company. According to the company, the above decision of the People's Committee of Hai Phong City is based on the Decision No. 2721/QD-UBND dated August 22, 2022 of the City People's Committee on dilating the land use time for EIE Company during the extension of the 24-month expiry date to implement the Project issued improperly in accordance with the law.
Therefore, EIE Company proposed that the Hai Phong City People's Committee cancel the decision to reclaim land No. 4511/QD-UBND dated December 29, 2022 and the decision to extend the land use period No. 2721/QD-UBND dated August 22, 2022 and consider allowing EIE Company to continue leasing land to implement the project.
Eie Company has made many petitions and complaints for the two decisions mentioned above of Hai Phong City People's Committee but is not considered for settlement; The company proposed to be dialogue with the Chairman of the City People's Committee with the participation of central agencies under the direction of the Government Inspectorate.
The representative of the company also said that the People's Committee of Hai Phong City only extended the company for 4 months due to the influence of Covid-19 translation, the enterprise has not yet implemented the project; The company has also invested in a number of items, not the vacant land ...
Previously, in 2005, the People's Committee of Hai Phong City decided to hand over 30,130 m2 of land at Lot 20A, Le Hong Phong Street, New Urban Area, Intersection 5 - Cat Bi Airport (in Dang Giang Ward, Ngo Quyen District, Hai Phong City) to EIE Company to implement the Investment Project to build EIE Commercial Center. According to the decision, the investor committed to completing the supermarket block in June 2006; in December 2010, completing the tower block with a scale of 21 floors.
However, according to the determination of the Hai Phong City People's Committee, EIE Company has just implemented the 3-storey supermarket construction on an area of over 16,000 m2 of land. The remaining 13,500 m2 of land belonging to the project, located right at the corner of Le Hong Phong - Nguyen Binh Khiem intersection, with a prime location in Hai Phong, is planned to build a 21-storey tower block, the investor is slow to put it into use.
After that, the Hai Phong City People's Committee decided to extend the 24 months of land use to create conditions for the company to implement the 21 -storey tower construction project. By the end of December 2022, the People's Committee of Hai Phong City had decided to recover more than 13,500 m2 of land above based on the provisions of Point i, Clause 1, Article 64 of the 2013 Land Law (land assigned by the State, leased to implement investment projects without being used in 12 consecutive months or 24 -month delayed land use schedule compared to the investment project from the investment project from the land -handed over the land to be handed over ...).
