In October 2025, the People's Committee of Khanh Hoa province issued 12 decisions to adjust and remove content related to "residential land not forming residential units" in resort and tourist area projects in the area.
The adjusted projects include: Hoa Vang Valley Tourism and villa (Nam Nha Trang ward); Royal Apartment Tourism and Hotel Area (Thai Nguyen Street, Tay Nha Trang ward); Tran Le Gia Trang Eco-tourism Resort (Hoa Thang ward); Hon Tam Island Tourism Area (Nha Trang ward); East Sea Resort (North of Cam Ranh Peninsula, Cam Lam ward); Gia Han Eco-tourism Area ( Bai Tuc - Hon Heo, Dong Ninh Hoa ward and Hoa Thang ward).

In addition, there are also projects such as Bao Dai High-end Resort (Cau Da area, Nha Trang ward); Sub-area VII - Golf Club (Nam Nha Trang ward); Nha Trang View Resort Villa Area (Nam Nha Trang ward); Ngoc Suong Eco-tourism Area (Binh Lap village and Nuoc Ngot village, Nam Cam Ranh ward); and Nha Trang Diamond Resort Eco-tourism Area (Pham Van Dong street, Bac Nha Trang ward).
The Provincial People's Committee assigned the Department of Agriculture and Environment to advise on the final handling of the content of eliminating "residential land not forming residential units" in land allocation decisions, land lease and land use right certificates of the project.
At the same time, the Provincial Tax Department is assigned to coordinate with relevant agencies to review and handle arising financial obligations, ensuring no budget loss.
According to the conclusion of the Government Inspectorate in Notice No. 1919/TB-TTCP dated November 4, 2020, the type of tourist villas, resort villas, and condotel apartments in Khanh Hoa, called "residential land not forming residential units" - has developed strongly, contributing to attracting investment, promoting tourism and increasing budget revenue.
However, this type of land has not been clearly regulated in land law, leading to many shortcomings, potential risks of disputes and complaints related to ownership term, land use rights and residence registration of secondary investors.
The Government Inspectorate has recommended that the Prime Minister direct ministries, branches and localities to handle the situation of investment and transfer of residential land not forming residential units in the direction of: still encouraging tourism investment, but ensuring no legal risks for investors, not blocking capital flows and gradually completing the legal framework.
In the immediate future, temporarily suspend new licensing for condotel projects until the legal system is completed.

Khanh Hoa province has 55 projects with the nature of "residential land not forming residential units".
For this type, Khanh Hoa province has urged investors to submit documents to adjust the planning in the direction of eliminating the type of "residential land not forming residential units". The projects are mainly adjusted from the type of "residential land not forming residential units" to commercial service land.
From 2023 to present, to avoid arising transactions related to residential land not forming residential units, in September 2023, Khanh Hoa province requested departments, branches and sectors to notify affiliated units, organizations and individuals to stop procedures related to the form of residential land not forming residential units until the land use purpose is adjusted in accordance with the provisions of the Land Law, no longer using the word "residential land not forming residential units".
