Many important contents are consulted before issuing new legal documents
On the afternoon of May 26, the Ministry of Finance held a national online conference to collect comments on draft legal documents in the financial sector, in order to implement the Party and State's policies on promoting decentralization, delegation of power and reorganizing local government at two levels.
In his opening speech, Minister of Finance Nguyen Van Thang emphasized that the completion of the legal document system this time is an important step to implement Conclusion 155-KL/TW of the Politburo on the arrangement of the apparatus and administrative units from now until June 30, 2025. In particular, a core requirement is to "review and implement decentralization and delegation of authority between relevant sectors and fields to ensure synchronization, comprehensiveness, connectivity, no omission or overlap or overlap of tasks".
Over the past time, the Ministry of Finance has coordinated to submit to the National Assembly amending and supplementing a series of important laws such as the State Budget Law, the Law on Management and Use of Public Assets, the Law on Tax Administration, the Law on Personal Income Tax, the Law on Public Investment, the Bidding Law ... in order to remove the institutional jam, promote growth and stabilize macroeconomic.
The Ministry has also chaired the National Assembly to issue 10 resolutions on piloting specific mechanisms for local development, including 27 decentralization and delegation of power policies in 10 major provinces and cities. In addition, at the 8th session of the 15th National Assembly, the legislative body agreed to institutionalize 3 new decentralization and delegation of power policies.
At the conference, Mr. Hoang Thanh Son - Director of the Legal Department - said that the Ministry of Finance would like opinions on 5 draft decrees and 7 draft circulars, focusing on key areas such as: public asset management, national reserves, statistics, taxes and fees. The goal is to create a clear legal corridor for decentralization and delegation of authority in accordance with the capacity of each level of government, while ensuring feasibility in implementation.
In addition, the draft circulars to collect opinions also concern agricultural land use tax, accounting - auditing, budget management, public investment disbursement reporting regime and financial civil servant professional standards. The Ministry of Finance affirmed that it will fully absorb all opinions at the conference, both directly and in writing, to complete the draft in a hands-on and easy-to-use direction.
Hanoi proposes clarifying authority between levels
Participating in the Conference, the representative of Hanoi People's Committee said that the city has actively reviewed and prepared the necessary conditions to change the model of two -level local government organizations. However, the reality shows that there are many issues that need clarification, especially in the delimitation of the authority between the provincial and commune levels when receiving the contents and tasks from the district level.
Hanoi recommends that there should be more specific and detailed instructions to serve as a basis for reviewing, classifying and developing appropriate decentralization plans, while facilitating the consultation on implementation in the model conversion phase.
Regarding the draft decree on the delimitation of the authority, the city representative proposes to adjust the regulations on ordering or bidding for providing public products and services to the commune level. In Hanoi - especially in the districts - these public services are still undertaken by the district level. The transfer of the commune, if there is no clear roadmap and guidance, it will create a great difficulty in the implementation organization, especially for bidding packages with complex elements or high technical requirements.
The city also proposed to add a flexible mechanism to allow the provincial People's Committee to decide on assigning to the commune level to implement, depending on the capacity of each locality.
Hanoi also expressed concern about regulations related to public service provision contracts, especially in the context of the proposed amendment of current regulations. The city representative said that with a huge workload in the two cities, especially Hanoi and Ho Chi Minh City, there needs to be more specific and practical solutions to remove obstacles and ensure the synchronous implementation of new policies.
"The application of technology in public financial management in large cities is still facing many difficulties, due to technical requirements and differences in scale and nature. I suggest that the Ministry of Finance study a specific mechanism or a suitable roadmap for big cities," emphasized the representative of Hanoi.
