As reported by Lao Dong Newspaper, Son Hai Group has just sent a document to the Binh Phuoc Provincial Construction Investment Project Management Board regarding the objection to the results of the selection of contractors for the Ho Chi Minh City - Thu Dau Mot - Chon Thanh Expressway Construction Package, the section passing through Binh Phuoc Province.
In the Bidding Minutes, this Package has 5 participating contractors and they are all big names in the transport infrastructure industry.
Of which, 4 contractors were hit by the lack of progress: Cienco4 Group Joint Stock Company and Son Hai Group Company Limited attended as independent entities; consortium contractors including Binh Phuoc Expressway Joint Venture (Dai Phong Infrastructure Construction Joint Stock Company - Vinaconex - Lu Gia Electromechanical Joint Stock Company) and Expressway Joint Venture IB250005761 (Hai Dang - Deo Ca - Thuan Ha Joint Stock Company). All 4 contractors were thualized with the same reason being that they did not achieve the technical assessment results.
Before opening the bidding, contractors had many opinions related to the technical evaluation standards for this package.
The contractor also requested that the bidding documents note: The contract to prove the experience in similar work of the personnel is a contract to implement the BIM application.
Therefore, the experience in similar jobs of the personnel is the completed BIM application implementation contract.
Contractors with personnel using the BIM model during the design phase must meet the requirements of E-HSMT.
Some contractors believe that the completed project has not used BIM applications during the construction process or very little, limiting the contractor and creating an advantage for a specific contractor.
Responding to this issue, the consultant for bidding said that from 2023, BIM will be applied to level I works, special level of new construction investment projects using public investment capital, foreign state capital for public investment and investment under the public-private partnership method (Decision No. 258/QD-TTg dated March 17, 2023).
Article 8, Decree 175/2024/ND-CP stipulates the application of BIM in construction activities for projects with a scale of Group B or higher at the time of project preparation.
E-HSMT only sets minimum requirements for BIM application personnel but does not set requirements for organizations and businesses. E-HSMT ensures competitiveness and does not limit contractors. Therefore, the claim that the Inviting Party limited the contractor is incorrect.
The contractor also asked, in chapter V "Technical requirements", the 3.2 "device" item, the record has the following: "The contractor provides technical documents must be a scan from the original (color version), and the contractor must prepare the original document to serve the document comparison when the bid solicitor is required".
However, according to chapter III. The evaluation criteria, in the category 5.4, meet the technical requirements of materials and equipment installed into the project, requirements of supplying materials and equipment according to the bidding progress, the bidding dossier stated as follows: "All attached documents must be notarized by the time of bid closure".
It is clear that there is no consistency between the invitation documents, leading to unclear bidders. For equipment required in item 3.2 of Chapter V "Technical requirements", the contractor must provide technical documents in the form of original scan (color) or notarized photocopy as stated by HSMT. Request the Inviting Party to clarify.
Responding to this issue, the bidding consultancy unit said that the E-HSDT assessment is based on the software files submitted by the Contractor on the National Bidding Network System. Section 3.2 in Chapter V of E-HSMT is a regulation on equipment. Section 5.4 in the assessment table in Chapter III of E-HSMT is the regulation on materials and supplies. Thus, E-HSMT regulations are very specific and do not conflict between contents.
