For the act of losing or reducing the thickness of the cultivated soil layer, it is required to restore the soil layer thickness as before the violation. The type of soil used to restore the cultivated soil layer must use the old soil that was taken away.
The act of changing the surface layer of agricultural land with materials, waste or soil mixed with sand, gravel, stone or soil with a different composition than the type of land used before the violation, must remove the materials, waste or soil mixed with sand, gravel, stone or soil with a different composition from the violating land area and restore the land surface to its original condition before the violation.
Acts that cause soil loss, erosion, or leaching of agricultural land that lead to loss or reduction of land usability have been identified. Depending on the violation, measures must be taken to rotate crops, plant cover crops, cultivate along contour lines, and build embankments and dykes to retain water and prevent soil erosion.
In case of changing the slope of the land surface; lowering the land surface, the land surface slope must be leveled and adjusted as before the violation, the land plot height must be re-leveled or the land must be leveled back to the level of the filled plot, and adjacent land must be restored.
The act of filling land with specialized water surface (except irrigation lakes), at the time of the decision to handle the violation, if the specialized water surface is still necessary for the determined purpose of use, the specialized water surface must be dredged to return to its original state as before the violation.
The act of leveling, raising, or lowering the surface of agricultural or aquaculture land that causes loss or reduction of the ability to use the land for the determined purpose must be leveled, restored to the height of the land plot, or the land must be leveled back to a state level with the adjacent land plot.
The People's Committee of Da Nang City also assigned the person who made the record of administrative violations to be responsible for coordinating with relevant agencies to organize inspections and confirm the results of the restoration level, measures to restore the original state of the land before the violation, and cases where it is not feasible to restore the original state of the land before the violation according to regulations. If there are any difficulties, problems, or inadequacies arising, relevant agencies, units, localities, organizations, and individuals shall promptly report to the Department of Natural Resources and Environment for synthesis and reporting to the People's Committee of the City for consideration.
