









Recently, Hue City Inspectorate just announced the inspection conclusion, pointing out many violations and shortcomings in the process of implementing the Hue Provincial Party Committee Guesthouse Project, causing the project to be delayed and had to be temporarily suspended.
According to the inspection conclusion, the investor, the unit entrusted to manage the project, the contractor and the consulting units had many violations during the implementation process. Notably, the consulting units prepared project dossiers, quality inspection dossiers and construction designs that were not in accordance with reality; there were cases of preparing inspection reports before signing contracts and before having a policy to study the project.
The project management unit advised on signing many contracts that were not in accordance with regulations; some contract contents were not consistent with the bidding documents, and did not specifically stipulate the recovery of advance payments. The Inspectorate also determined that the investor signed contract appendices directly with subcontractors contrary to the provisions of the Bidding Law; allowed the transfer of more than 67% of the workload from the main contractor to the subcontractor not in accordance with regulations; adjusted to reduce the value of contract performance assurance contrary to legal regulations.
Inaccurate acceptance of some items leads to the recovery of excess payment value; some items are constructed not in accordance with the approved design or constructed before the design adjustment dossier is approved.
According to Hue City Inspectorate, the subjective cause stems from the irresponsibility of the project management unit and consulting units in advising and completing legal documents. The investor lacks experience in project management, while the main contractor, Thien Phat Thinh Investment Construction and Trading Joint Stock Company, no longer has enough capacity to continue to implement the contract.
Faced with the above violations, Hue City Inspectorate proposed that the Standing Committee of the City Party Committee direct the consideration of the responsibilities of related individuals; request to sanction contractors who violate progress, and carry out contract termination procedures according to regulations.
The Inspectorate also proposed changing the project investor, assigning a specialized project management unit to continue implementation; and at the same time requested to re-evaluate the load-bearing safety of the project, review investment efficiency before adjusting and re-implementing the project.
