According to the draft amendment to the Construction Law (D draft Law), in the coming time, projects that have been appraised by a professional agency and reported for feasibility study will be exempted from construction permits.
For small projects and individual houses that do not have detailed planning, the licensing procedures are still kept unchanged, but can be done online to make it more convenient for people.
At a meeting on September 12 with ministries and branches to listen to reports and give opinions on amending the Construction Law, Deputy Prime Minister Tran Hong Ha emphasized that people and businesses "should not be afraid of license names", because "if the feasible design documents have fully integrated the necessary contents, the licensing will be almost only for confirmation".
The Deputy Prime Minister must speak up to reassure because the reality has shown that for many years, construction permits have always been among the group of administrative procedures that cause the most inconvenience and concern for people and businesses.
Even in the most favorable conditions, that is, when the project is legal, there are no disputes or complaints, the documents are complete and in accordance with regulations, etc., the investor still has to go through many steps, many doors, and submit many types of duplicate documents to apply for a construction permit.
In many cases, when the dossier is "soaked" and required to be supplemented many times, investors are forced to "run", having to collude with negativity and harassment to soon have the dossier approved.
In reality, it shows that the same type of project but each locality has different requirements. Some places are licensed very quickly, while others take many months. This inconsistency increases risks and makes people and businesses feel unpredictable.
The construction permit, in essence, as Deputy Prime Minister Tran Hong Ha affirmed, "is the final management tool, ensuring that the project meets planning, design, fire prevention and fighting, and the environment".
However, if the licensing procedures are still heavy in form, not giving a clear sense of legal value or actual benefits, people and businesses will only find it a hasard, even "the main business".
To eliminate and end the fear of having the name "build permit" and bring the permit back to its "assertment" nature, ideally, implement the "one-stop, one set of documents" model.
Accordingly, people only need to submit their application once, at a single location, and will be completely resolved. At the same time, it is necessary to shorten processing time and make the process transparent to minimize negativity.
When people and businesses can look up the processing progress online, know where their documents are, and who is responsible, the fear of the name "construction permit" will gradually disappear.
When the construction permit is truly affirming, transparent, no longer has underlying costs, and is not harassed, the concern will be replaced by trust, affirming legal value and ensuring a safe and sustainable project.
