The reason is partly due to the regulations on acts of "hiding, debt, slow, and payment of social insurance" in the Law on Social Insurance (former) and the guiding documents are not really specific and clear.

The inadequacies have been identified and amended in the Law on Social Insurance 2024, with a series of notable new points. The law clearly states the responsibilities of the state agencies in determining and managing the subjects participating in social insurance, and tightening the sanctions measures to handle the situation of slow and late closing. Most importantly, this behavior is also supplemented with the basis for criminal handling.

However, the Law on Social Insurance (new) is only effective from 1.7.2025, and must still wait for detailed guidance documents of the Government to go into practice. Therefore, in the waiting phase, it is likely that the authorities still face difficulties in handling large number of social insurance debts such as Van Ha Garment Joint Stock Company.

But even if the incident in Thanh Hoa is not necessarily "reality" - it is unclear whether there is enough elements to constitute criminals to prosecute, this step still has a great deterrent meaning.

It is a strong warning, that, any business "hugs" the debt of social insurance for billions of dong, directly affecting the benefits of hundreds, thousands of workers, and at risk of being examined. Criminal responsibility.
