State management of teachers is currently carried out by many Laws (Civil Servant Law, Public Employee Law, Education Law, Vocational Education Law, Labor Law...) leading to difficulties in the process of research, implementation and organization at the grassroots level.
The management of payroll still overlaps between the Department of Home Affairs and the Department of Education. The education sector is assigned the total payroll while the recruitment authority belongs to the Department of Home Affairs.

Teacher management has been overlapping up to now, the education sector has not been proactive in allocating, mobilizing, and arranging the use of teacher staff. Please give evidence that the department level manages cadres, civil servants, teachers, and students at the high school level, while the high school boarding schools for ethnic minorities in the area, the remaining levels of education are under the functions and tasks of the district-level Department of Education and Training, which is directly managed by the district-level People's Committee.
That means, for schools under the management of the District People's Committee, the Department of Education and Training has no rights or limited rights to decide on personnel.
Because of this overlap, and the limited management of the education sector in a locality, there is a difficult, even negative situation in recruiting teachers. A teacher applying for a job, not only goes through the education sector, but also the district. Many people have the right to decide on recruitment, so teachers have a hard time finding a place for themselves on the podium.
The lack of full authority in the education sector to decide on the recruitment and use of teachers is also the reason why there are some places with excess teachers and some places with shortages. If the authority is given to the education sector, there will be a "conductor" who will manage and operate all the local education personnel. Thus, there will be conditions to ensure the quantity and increase the quality of the teaching staff. Of course, to achieve this, there must be talented and dedicated education leaders.
Not only is it about delegating power to the education sector, but also about delegating power to schools to actively recruit teachers. This is an important breakthrough, only by recruiting personnel based on criteria of pedagogical capacity and professional qualifications can the quality of teaching and learning be improved.
Just look at non-public schools and you will see that teacher recruitment is not as burdensome as public schools, because private schools require pedagogical capacity to employ people. Many private schools are famous for their high quality of teaching because their teacher input is very high.
