According to the report at the Conference, the Law on Land Use Rights was passed on June 19, 2014 at the 7th Session of the 13th National Assembly with 133 articles and 9 chapters. The law plays a role in regulating core social relations (marriage, parents - children, other family members in family relationships), protecting the legitimate rights of members, building a prosperous and progressive Vietnamese family, promoting the fine cultural traditions of the Vietnamese family, ensuring gender equality, creating a happy environment, and conditions for the development of each individual.
Speaking at the conference, Ms. Nghiem Xuan Hanh - representative of the Department of Mothers and Children, Ministry of Health - said that currently, the reproductive support network of the Ministry of Health has made remarkable progress.
nationwide, there are up to 70 medical examination and treatment facilities performing in vitro fertilization techniques, of which 7 facilities are performing surrogacy techniques for humanitarian purposes.
It is estimated that up to now, about 170,000 babies have been born by in vitro fertilization and more than 500 babies have been born by civil surrogacy techniques nationwide. This has brought happiness to hundreds of thousands of families.

However, Ms. Nghiem Xuan Hanh said that the regulation that surrogate mothers must be "a relative who likes to have the same goods as the wife or the husband who asked to have a surrogate mother" is a very strict regulation, very difficult to implement.
In practice, in many cases, couples who are prescribed surrogacy but cannot find relatives who like the same goods. The most common cause is that relatives who like to be in the same hang are women who are not of childbearing age or do not have enough health to get pregnant.
"This is one of the reasons why people - due to lack of understanding of the law - choose the surrogacy solution" - Ms. Hanh emphasized.
For this reason, Ms. Nghiem Xuan Hanh said that many assisted reproductive support units have proposed expanding the conditions for surrogate mothers to have more opportunities for women who cannot become pregnant to have the opportunity to become mothers.
Also at the conference, Mr. Nguyen Van Vu - Deputy Director of the Ho Chi Minh City Department of Justice - also pointed out a number of new issues arising in social life that have not been fully regulated by law, such as gender conversion, same-sex relationships, digital assets, virtual assets; In practice, there are still difficulties in distinguishing between surrogacy for humanitarian purposes and commercial purposes...
Thereby, Mr. Nguyen Van Vu proposed to perfect the regulations on surrogacy for humanitarian purposes, supplement the criteria for identifying prohibited commercialization; at the same time, consider expanding to include conditions for some cases with legitimate surrogate needs, in accordance with social reality.
This person also recommended that the Ministry of Justice and central agencies study and promulgate the Law on Gender Transformation to have a legal basis to resolve issues related to household registration, marriage, and family of people who have changed their gender.
