Not yet agreed with 14/88 Laws and Orders
At the 43rd session of the National Assembly Standing Committee on the morning of March 10, the National Assembly listened to Deputy Minister of Science and Technology Le Xuan Dinh present the draft Law amending and supplementing a number of articles of the Law on Product and Goods Quality.
According to Mr. Dinh, after being amended and supplemented, the Law on Product and Goods Quality has 6 chapters and 66 articles (due to the 19th, 20th, and 25th articles being adjusted in the Law amending and supplementing a number of articles of the Law on Technical Standards and Regulations and Articles 30, 35, 36, 39, 40, and 44 being abolished in this Law, and at the same time adding 3 articles, the number of articles is reduced by 6 articles compared to the current Law).

Regarding the group of laws and laws with problems and overlaps with the Law on Product and Goods Quality, Mr. Dinh said that, through review, it is shown that 14 out of 88 Laws and Orders have problems and are not consistent with the Law on Product and Goods Quality, including: Law on Food Safety, Law on Forestry, Law on Fisheries, Law on Crop Production, Law on Livestock, Law on Veterinary Medicine, Law on Technical Standards and Regulations, Law on Pharmacy, Law on Labor Safety and Hygiene, Law on Commerce, Law on Customs, Law on Prices, Law on Fees and Charges, Ordinance on Market Management.
The problematic content, not yet unified, focuses on: Concept of some phrases such as " concern", "experimental", "inspection", " certification", "recognition", " tracing the origin", "assessing the suitability" in the laws: Law on Food Safety, Law on Seafood, Law on Crop Production, Law on Animal Husbandry, Law on Technical Standards and Regulations, Law on Pharmacy, Law on Safety and Hygiene, Law on Labor, Law on Trade, Law on Customs, Law on Prices; Activities to trace the origin of products and goods in the laws: Forestry Law, Law on Seafood, Law on Crop Production, Law on Food Safety; Activities to assess the suitability of laws: Law on Technical Standards and Regulations, Law on Food Safety; Law on Inspection of Production and Quality of Goods at the Law on General Inspection, Law on Production and Service...
According to the Deputy Minister of Science and Technology, guiding documents for implementation or other legal documents that need to be amended to comply with the provisions of the draft Law have also been reviewed and specifically expressed in the Report on reviewing legal documents related to the draft Law.
Need to review and avoid conflicts between Laws
Presenting the review report, Chairman of the National Assembly's Committee for Science, Technology and Environment Le Quang Huy said that the Standing Committee of the Committee for Science, Technology and Environment agreed with the necessity of amending and supplementing a number of articles of the Law on Product and Goods Quality.
The amended and supplemented content in the Basic Law is consistent with the Party's guidelines and policies, the State's laws and 4 groups of policies proposing to amend the Law passed by the National Assembly; ensuring the constitutionality, legality, consistency of the draft Law with the legal system and compatible with relevant international treaties to which Vietnam is a member.
"It is necessary to review to ensure compliance with relevant legal regulations; ensure innovation in thinking in law-making work," Mr. Huy emphasized.

Discussing at the meeting, Chairman of the Law and Justice Committee Hoang Thanh Tung said that the Law on Product and Goods Quality has been issued for a long time, although it was amended in 2018, there are still some overlaps with other laws.
"Many provisions in this law have new relevant laws with impact, for example, conflicts with the Law on Consumer Protection of Rights... Or the issue of specialized inspection in Articles 52 and 53. The Government will draft a new Law on Inspection, in the spirit of reorganizing the inspection apparatus, no longer having specialized inspections at ministries. Thus, are articles 52 and 53 still relevant? ", Mr. Tung emphasized.
According to Mr. Tung, the issue of the Law on Product and Goods Quality conflicting with other laws is an issue that the Government needs to put in perspective. It is recommended to continue reviewing and clarifying the scope of regulation. It is necessary to adjust the draft law accordingly.
