On the morning of June 3, the National Assembly Standing Committee gave its opinion on the reception, explanation, and revision of the draft Law amending and supplementing a number of articles of the Law on Organization of People's Courts (TAND).
Regarding the establishment of a specialized court under the international financial center, the Supreme People's Court stated that this is an urgent requirement and requirement of practice and has been approved by competent authorities.
However, this is a very big and new problem for Vietnam, so it is expected to be regulated that the People's Court system will have specialized courts.
Reporting on this issue, Chief Justice of the Supreme People's Court Le Minh Tri said that after receiving the policy from the competent authority, the Government is urgently deploying international financial centers in Ho Chi Minh City and Da Nang.
This must be consistent with Vietnamese law and must be issued by the National Assembly. This is a very specific and narrow activity, we cannot amend other laws but only build specific laws, Mr. Le Minh Tri analyzed and suggested that a separate law should be urgently developed.
This center must comply with Vietnamese law as prescribed by the National Assembly, moreover, due to its specific nature, it is necessary to urgently develop its own law, and cannot amend other laws.
The Supreme People's Court is organizing surveys and researching experiences in a number of countries to quickly report to the Politburo. In the immediate future, it is stipulated that in the court organization system, there will be specialized courts under the international financial center, and the detailed content will be assigned to the National Assembly Standing Committee for regulation and decision.
"Regarding the criteria for judges, how to appoint or hire, the language, there are many problems, we have to study. In the immediate future, it is determined that there will be a specialized court in this law, but the detailed content will be assigned to the National Assembly Standing Committee to regulate, said the Chief Justice.
In this law amendment, the Chief Justice emphasized the need to ensure the principles approved by the Politburo, which is to organize a 3-level court model ( Supper highest court, provincial and regional court); abolish intermediary level and increase decentralization and delegation of authority to the lower levels.
Therefore, in this period, the court sector has 2 very strong fluctuations, said Chief Justice Le Minh Tri.
One is the establishment of regional courts. According to the Chief Justice, there were previously 693 district courts, now there are only 355 regional courts, which is only nearly 1/2, but the tasks, functions, and nature of the work assigned to regional courts are very large.
In the near future, the Supreme People's Court must increase resources and human resources to ensure the court is in the area of performing new duties, because the number and nature of the work is large in criminal, civil, administrative and commercial cases, the Chief Justice informed.
Second, it is necessary to synchronously implement measures to ensure resources and human resources to work in regional courts. Accordingly, it is normal for senior judges to work in regional courts, not like before, there were only primary judges.
